Part A: Plain English Summary<\/h2>\n

Agreement for Temple Trustees and Managers<\/h3>\n

This agreement is for the individuals or committees who manage temple listings on Utsav Mandirs\u2122. It establishes the relationship between the temple and our platform.<\/p>\n

The Simple Truth<\/h3>\n

  • \n

    You represent the temple<\/strong>: By accepting this agreement, you confirm you have authority to act for the temple.<\/p>\n<\/li>\n

  • \n

    You control the listing<\/strong>: You can update information, respond to reviews, and manage temple presence.<\/p>\n<\/li>\n

  • \n

    You’re responsible for accuracy<\/strong>: The information you provide should be correct and current.<\/p>\n<\/li>\n

  • \n

    You agree to our rules<\/strong>: Temple listings must follow our guidelines.<\/p>\n<\/li>\n

  • \n

    We’re not your partner<\/strong>: This is a platform relationship, not a partnership or joint venture.<\/p>\n<\/li>\n<\/ul>\n

    \n

    Part B: Legal Terms and Conditions<\/h2>\n

    1. Parties and Relationship<\/h3>\n

    1.1<\/strong>\u00a0This Temple Operator Agreement (“Agreement”) is entered into between:<\/p>\n

    • \n

      MyMahotsav Futuretech Ltd<\/strong>\u00a0(“Company,” “we,” “us,” “our”)<\/p>\n<\/li>\n

    • \n

      The individual or entity accepting this Agreement (“Temple Operator,” “you,” “your”)<\/p>\n<\/li>\n<\/ul>\n

      1.2<\/strong>\u00a0The Temple Operator represents and warrants that they have the full legal authority to bind the temple to this Agreement.<\/p>\n

      1.3<\/strong>\u00a0Independent Contractor<\/strong>: The Temple Operator is an independent contractor. Nothing in this Agreement creates a partnership, joint venture, agency, or employment relationship.<\/p>\n

      2. Temple Listing Management<\/h3>\n

      2.1<\/strong>\u00a0Upon verification, the Temple Operator gains access to the Temple Dashboard to manage:<\/p>\n

      • \n

        Temple information (name, location, timings, etc.)<\/p>\n<\/li>\n

      • \n

        Photos and videos<\/p>\n<\/li>\n

      • \n

        Puja\/service offerings<\/p>\n<\/li>\n

      • \n

        Event listings<\/p>\n<\/li>\n

      • \n

        Crowdfunding campaigns<\/p>\n<\/li>\n

      • \n

        Community group connections<\/p>\n<\/li>\n<\/ul>\n

        2.2<\/strong>\u00a0The Temple Operator agrees to:<\/p>\n

          \n
        • \n

          Maintain accurate information<\/p>\n<\/li>\n

        • \n

          Respond promptly to devotee inquiries<\/p>\n<\/li>\n

        • \n

          Update listings when information changes<\/p>\n<\/li>\n

        • \n

          Comply with all applicable laws<\/p>\n<\/li>\n<\/ul>\n

          3. Operator Representations and Warranties<\/h3>\n

          3.1<\/strong>\u00a0The Temple Operator represents and warrants that:<\/p>\n

            \n
          • \n

            They have full authority to act for the temple<\/p>\n<\/li>\n

          • \n

            All information provided is accurate and complete<\/p>\n<\/li>\n

          • \n

            The temple complies with all applicable laws<\/p>\n<\/li>\n

          • \n

            The temple holds necessary permits and registrations<\/p>\n<\/li>\n

          • \n

            The temple is not engaged in illegal activities<\/p>\n<\/li>\n

          • \n

            They will not use the platform for unauthorized purposes<\/p>\n<\/li>\n<\/ul>\n

            4. Temple Obligations<\/h3>\n

            4.1<\/strong>\u00a0The temple agrees to:<\/p>\n

              \n
            • \n

              Maintain a safe environment for devotees<\/p>\n<\/li>\n

            • \n

              Comply with all applicable laws (charity, tax, religious endowments)<\/p>\n<\/li>\n

            • \n

              Honor any commitments made through the platform<\/p>\n<\/li>\n

            • \n

              Respond to devotee communications in a timely manner<\/p>\n<\/li>\n

            • \n

              Not discriminate unlawfully<\/p>\n<\/li>\n<\/ul>\n

              5. Fees and Payments<\/h3>\n

              5.1<\/strong>\u00a0Free Listings<\/strong>: Basic temple listings are free.<\/p>\n

              5.2<\/strong>\u00a0Premium Features<\/strong>: Certain enhanced features may require payment as disclosed.<\/p>\n

              5.3<\/strong>\u00a0Transaction Fees<\/strong>: If the temple uses paid services (crowdfunding, ticket sales), applicable fees will be disclosed.<\/p>\n

              6. Intellectual Property<\/h3>\n

              6.1<\/strong>\u00a0The temple retains ownership of all content it provides.<\/p>\n

              6.2<\/strong>\u00a0The temple grants the Company a license to display, distribute, and promote temple content as described in Document 2.<\/p>\n

              7. Termination<\/h3>\n

              7.1<\/strong>\u00a0Either party may terminate this Agreement:<\/p>\n

              • \n

                At any time, for any reason, with 30 days’ notice<\/p>\n<\/li>\n

              • \n

                Immediately for material breach<\/p>\n<\/li>\n<\/ul>\n

                7.2<\/strong>\u00a0Upon termination:<\/p>\n

                  \n
                • \n

                  Temple listing will be removed or returned to unverified status<\/p>\n<\/li>\n

                • \n

                  Any paid fees are non-refundable<\/p>\n<\/li>\n

                • \n

                  Ongoing obligations (indemnification) survive<\/p>\n<\/li>\n<\/ul>\n

                  8. Limitation of Liability<\/h3>\n

                  8.1<\/strong>\u00a0TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR:<\/p>\n

                  • \n

                    Any indirect, incidental, or consequential damages<\/p>\n<\/li>\n

                  • \n

                    Any disputes between temple and devotees<\/p>\n<\/li>\n

                  • \n

                    Any claims arising from temple operations<\/p>\n<\/li>\n<\/ul>\n

                    8.2<\/strong>\u00a0The Company’s total liability shall not exceed the fees paid by the temple in the preceding 12 months.<\/p>\n

                    9. Indemnification<\/h3>\n

                    9.1<\/strong>\u00a0The Temple Operator agrees to indemnify and hold the Company harmless from any claims arising out of:<\/p>\n

                      Temple operations<\/p>\n<\/li>\n

                    • \n

                      Inaccurate information provided<\/p>\n<\/li>\n

                    • \n

                      Violation of laws by the temple<\/p>\n<\/li>\n

                    • \n

                      Disputes with devotees<\/p>\n<\/li>\n<\/ul>\n

                      \n

                      Part C: Jurisdiction-Specific Addendums<\/h2>\n

                      India Addendum<\/h3>\n

                      HR&CE Compliance<\/strong>: Temples under state HR&CE departments must comply with applicable regulations. Listing information should be consistent with official records.<\/p>\n

                      UK\/EU Addendum<\/h3>\n
