Think of it as a dictionary that helps you understand exactly what we mean when we use certain words.<\/p>\n<h3>The Simple Truth<\/h3>\n<ul>\n<li>\n<p class=\"ds-markdown-paragraph\"><strong>Consistent meanings<\/strong>: These definitions apply across all our policies.<\/p>\n<\/li>\n<li>\n<p class=\"ds-markdown-paragraph\"><strong>Capitalized terms<\/strong>: Words that start with capital letters have special meanings defined here.<\/p>\n<\/li>\n<li>\n<p class=\"ds-markdown-paragraph\"><strong>If you&#8217;re unsure, check here<\/strong>: Whenever you see a capitalized term, you can look it up in this document.<\/p>\n<\/li>\n<\/ul>\n<hr \/>\n<h2>Part B: Legal Definitions<\/h2>\n<p class=\"ds-markdown-paragraph\"><strong>Account<\/strong>\u00a0means a registered account on the Utsav Appointments\u2122 platform, accessible with unique credentials, through which a Host can create and manage Availability, share Booking Links, and access the Services.<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>Applicable Law<\/strong>\u00a0means all applicable laws, regulations, ordinances, and governmental orders, whether local, state, national, or international, that govern or may govern the Services or a party&#8217;s use thereof, including but not limited to data protection laws, privacy laws, and consumer protection laws.<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>Authorized User<\/strong>\u00a0means an individual who is authorized by a Host Entity to access and use the Services under the Host Entity&#8217;s account, such as employees, consultants, contractors, or agents.<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>Availability<\/strong>\u00a0means the specific dates, times, and duration of time slots that a Host has designated as open for booking by Invitees through the Services.<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>Booking<\/strong>\u00a0means a confirmed scheduling of a meeting or appointment between a Host and an Invitee through the Services.<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>Booking Link<\/strong>\u00a0means the unique URL generated by the Services that a Host can share with Invitees to allow them to view Availability and schedule Bookings.<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>Business Day<\/strong>\u00a0means a day (other than a Saturday, Sunday, or public holiday) on which banks are open for general business in London, United Kingdom.<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>Confidential Information<\/strong>\u00a0means any information disclosed by one party to the other, either directly or indirectly, in writing, orally, or by drawings or observation, that is designated as confidential or that reasonably should be understood to be confidential given the nature of the information and circumstances of disclosure.<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>Customer<\/strong>\u00a0or\u00a0<strong>Host<\/strong>\u00a0means the individual or Entity that has registered for an Account to use the Services. &#8220;Customer&#8221; and &#8220;Host&#8221; are used interchangeably in these documents.<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>Customer Data<\/strong>\u00a0means all information, data, text, messages, communications, materials, and other content submitted to the Services by or on behalf of a Customer (including by its Authorized Users and Invitees).<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>Data Protection Laws<\/strong>\u00a0means all applicable laws relating to the processing of personal data, privacy, and data security, including but not limited to (where applicable) the GDPR, UK GDPR, CCPA, and India&#8217;s Digital Personal Data Protection Act, 2023.<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>Dispute<\/strong>\u00a0means any claim, controversy, or dispute (whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory) arising out of or relating to these Terms, the Services, or the relationship between the parties.<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>Documentation<\/strong>\u00a0means the user guides, online help, technical documentation, and other materials provided by Utsav Appointments\u2122 to assist Customers in using the Services.<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>Entity<\/strong>\u00a0means a company, corporation, partnership, association, trust, governmental organization, or other legal entity.<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>Fees<\/strong>\u00a0means the charges payable by a Customer for use of the Services, including any subscription fees, usage fees, or other charges as set forth on the Website or in an Order Form.<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>Free Account<\/strong>\u00a0means an Account that provides access to basic features of the Services without charge, subject to any limitations described on the Website.<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>Host<\/strong>\u00a0\u2013 see &#8220;Customer.&#8221;<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>Host Entity<\/strong>\u00a0means a Customer that is an Entity, as distinguished from an individual Customer.<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>Intellectual Property Rights<\/strong>\u00a0means all patents, copyrights, trademarks, trade secrets, and other proprietary rights recognized in any jurisdiction.<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>Invitee<\/strong>\u00a0means an individual who (a) has received or is accessing a valid Booking Link made available by a Host; (b) uses such link to schedule a Booking with a Host; or (c) participates in a meeting utilizing the meeting intelligence or recording features of the Services.<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>Invitee Terms<\/strong>\u00a0means the terms and conditions applicable to Invitees, as set forth in Document 3.<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>Meeting Intelligence Services<\/strong>\u00a0means any features of the Services that utilize artificial intelligence or similar technologies to record, transcribe, summarize, or analyze meetings scheduled through the Services.<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>Order Form<\/strong>\u00a0means an online ordering page or written document executed by the parties that specifies the Services to be provided, the Fees, and other related terms.<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>Paid Account<\/strong>\u00a0means an Account for which Fees are paid to access premium features of the Services.<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>Personal Data<\/strong>\u00a0means any information relating to an identified or identifiable individual that is processed by Utsav Appointments\u2122 on behalf of a Customer in connection with the Services.<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>Privacy Notice<\/strong>\u00a0means Utsav Appointments\u2122&#8217; privacy notice, as updated from time to time, which describes how personal information is collected, used, and shared.<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>Services<\/strong>\u00a0means the Utsav Appointments\u2122 calendar scheduling and availability sharing platform, including all related features, functionality, and applications provided by Utsav Appointments\u2122.<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>Term<\/strong>\u00a0means the duration of a Customer&#8217;s subscription to the Services, as set forth in the applicable Order Form or, for Free Accounts, the period during which the Customer maintains an Account.<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>Terms<\/strong>\u00a0means collectively all terms, conditions, policies, and addendums governing use of the Services, including the Host Terms, Invitee Terms, Acceptable Use Policy, Privacy Notice, and any other documents incorporated by reference.<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>Third-Party Applications<\/strong>\u00a0or\u00a0<strong>TPAs<\/strong>\u00a0means web-based or mobile applications, integrations, or services that are provided by third parties and interoperate with the Services, such as calendar services (Google Calendar, Outlook) and video conferencing platforms (Zoom, Google Meet).<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>Utsav Appointments\u2122<\/strong>\u00a0means the appointment scheduling service provided by MyMahotsav Futuretech Ltd, a company incorporated under the laws of England and Wales (Company Number 13949925), with its registered office at [Address].<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>Visitor<\/strong>\u00a0means an individual who visits the Utsav Appointments\u2122 website but does not have an Account and is not an Invitee accessing a Booking Link.<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>Website<\/strong>\u00a0means the Utsav Appointments\u2122 website accessible at\u00a0<a href=\"https:\/\/appointments.utsavworld.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">appointments.utsavworld.com<\/a>\u00a0or such other URL as may be designated by Utsav Appointments\u2122.<\/p>\n<hr \/>\n<h2>Part C: Interpretation Rules<\/h2>\n<p class=\"ds-markdown-paragraph\"><strong>1.1<\/strong>\u00a0Words importing the singular shall include the plural and vice versa.<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>1.2<\/strong>\u00a0References to &#8220;including&#8221; mean &#8220;including without limitation.&#8221;<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>1.3<\/strong>\u00a0Headings are for convenience only and do not affect interpretation.<\/p>\n<p class=\"ds-markdown-paragraph\"><strong>1.4<\/strong>\u00a0References to &#8220;these Terms&#8221;
