Part A: Plain English Summary<\/h2>\n

Agreement with Contest Sponsors<\/h3>\n

This document is for external brands or companies that wish to sponsor or co-host contests on Utsav Contests\u2122. It defines the relationship between MyMahotsav and the Sponsor.<\/p>\n

The Simple Truth<\/h3>\n

  • \n

    Sponsors Provide Prizes\/Funding<\/strong>: Sponsors may fund prizes or provide promotional support.<\/p>\n<\/li>\n

  • \n

    MyMahotsav Administers the Contest<\/strong>: We run the contest, manage entries, and handle judging.<\/p>\n<\/li>\n

  • \n

    Sponsors Get Recognition<\/strong>: Sponsors are acknowledged in contest materials.<\/p>\n<\/li>\n

  • \n

    No Control Over Judging<\/strong>: Sponsors do not influence winner selection unless agreed.<\/p>\n<\/li>\n

  • \n

    Content Usage Rights<\/strong>: Sponsors may get licenses to use winning entries for promotion.<\/p>\n<\/li>\n<\/ul>\n

    Part B: Legal Terms and Conditions<\/h2>\n

    1. DEFINITIONS<\/h3>\n

    1.1<\/strong>\u00a0“Sponsor”<\/strong>\u00a0means the third-party company or organization co-hosting the Contest with MyMahotsav.<\/p>\n

    1.2<\/strong>\u00a0“Contest”<\/strong>\u00a0means the specific contest described in the attached Schedule A.<\/p>\n

    1.3<\/strong>\u00a0“Prize”<\/strong>\u00a0means the awards to be provided by Sponsor to Contest winners.<\/p>\n

    2. SPONSOR RESPONSIBILITIES<\/h3>\n

    2.1<\/strong>\u00a0Sponsor agrees to:<\/p>\n

      \n
    • \n

      Provide the Prize(s) as described in Schedule A<\/p>\n<\/li>\n

    • \n

      Fund any agreed-upon Contest costs<\/p>\n<\/li>\n

    • \n

      Provide brand assets (logo, description) for promotion<\/p>\n<\/li>\n

    • \n

      Designate a point of contact for Contest coordination<\/p>\n<\/li>\n

    • \n

      Comply with all applicable laws regarding prize provision<\/p>\n<\/li>\n<\/ul>\n

      2.2<\/strong>\u00a0Prize Delivery<\/strong>: Sponsor is responsible for delivering Prizes to winners within [thirty (30)] days of winner confirmation, unless otherwise agreed.<\/p>\n

      2.3<\/strong>\u00a0Taxes<\/strong>: Sponsor is responsible for any tax reporting or withholding obligations related to the Prizes, unless otherwise agreed.<\/p>\n

      3. MYMAHOTSAV RESPONSIBILITIES<\/h3>\n

      3.1<\/strong>\u00a0MyMahotsav agrees to:<\/p>\n

        \n
      • \n

        Administer the Contest in accordance with Utsav Contests\u2122 Official Rules<\/p>\n<\/li>\n

      • \n

        Manage entry collection and judging<\/p>\n<\/li>\n

      • \n

        Select winners according to published criteria<\/p>\n<\/li>\n

      • \n

        Notify winners and coordinate Prize fulfillment<\/p>\n<\/li>\n

      • \n

        Promote the Contest and acknowledge Sponsor<\/p>\n<\/li>\n<\/ul>\n

        4. INTELLECTUAL PROPERTY RIGHTS<\/h3>\n

        4.1<\/strong>\u00a0Sponsor Materials<\/strong>: Sponsor grants MyMahotsav a non-exclusive, royalty-free license to use Sponsor’s name, logo, and trademarks solely for Contest promotion.<\/p>\n

        4.2<\/strong>\u00a0Entrant Content<\/strong>: Sponsor acknowledges that entrants retain ownership of their content. Sponsor may receive a license to use winning entries as specified in Schedule A.<\/p>\n

        4.3<\/strong>\u00a0No Endorsement<\/strong>: Nothing in this Agreement implies that entrants or MyMahotsav endorse Sponsor’s products or services.<\/p>\n

        5. SPONSOR INVOLVEMENT IN JUDGING<\/h3>\n

        5.1<\/strong>\u00a0Jury Participation<\/strong>: If Sponsor wishes to participate in judging, this must be specified in Schedule A. Sponsor representatives serving as judges must comply with the Jury Member Code of Conduct (CT-16).<\/p>\n

        5.2<\/strong>\u00a0No Undue Influence<\/strong>: Sponsor agrees not to attempt to influence judging outcomes improperly.<\/p>\n

        5.3<\/strong>\u00a0Final Decisions<\/strong>: MyMahotsav retains final authority over winner selection.<\/p>\n

        6. REPRESENTATIONS AND WARRANTIES<\/h3>\n

        6.1<\/strong>\u00a0Sponsor represents and warrants that:<\/p>\n

          \n
        • \n

          It has the authority to enter this Agreement<\/p>\n<\/li>\n

        • \n

          It will provide Prizes as promised<\/p>\n<\/li>\n

        • \n

          Its participation complies with applicable laws<\/p>\n<\/li>\n

        • \n

          Its products\/services are not illegal or deceptive<\/p>\n<\/li>\n<\/ul>\n

          7. LIMITATION OF LIABILITY<\/h3>\n

          7.1<\/strong>\u00a0Neither party shall be liable for indirect, incidental, or consequential damages.<\/p>\n

          7.2<\/strong>\u00a0MyMahotsav’s total liability shall not exceed the value of Sponsor’s contribution to the Contest.<\/p>\n

          8. TERMINATION<\/h3>\n

          8.1<\/strong>\u00a0Either party may terminate this Agreement if the other breaches material terms.<\/p>\n

          8.2<\/strong>\u00a0Upon termination, MyMahotsav may cancel the Contest or continue without Sponsor recognition.<\/p>\n","protected":false},"excerpt":{"rendered":"
