Your Agreement as a Utsav Jyotish\u2122 Astrologer<\/h3>\n

Welcome to Utsav Jyotish\u2122! This document is your legal agreement with us when you join our platform as an astrologer.<\/p>\n

The Simple Truth<\/h3>\n
    \n
  • \n

    You’re an Independent Professional<\/strong>: You are not an employee of MyMahotsav. You control your practice, your prices, and your availability\u00a0.<\/p>\n<\/li>\n

  • \n

    You Set Your Own Terms<\/strong>: You decide when you’re available, what services you offer, and how much you charge.<\/p>\n<\/li>\n

  • \n

    Ethics Matter<\/strong>: We have a strict Code of Conduct. Treat clients with respect, be honest, and don’t make false promises\u00a0.<\/p>\n<\/li>\n

  • \n

    You’re Responsible for Your Advice<\/strong>: You’re accountable for what you tell clients. We provide the platform, but you’re the expert.<\/p>\n<\/li>\n

  • \n

    We Share Revenue<\/strong>: You earn a percentage of consultation fees; the rest covers platform costs.<\/p>\n<\/li>\n<\/ul>\n

    Part B: Legal Terms and Conditions<\/h2>\n

    2. ELIGIBILITY AND APPLICATION<\/h3>\n

    2.1<\/strong>\u00a0To become an Astrologer on Utsav Jyotish\u2122, you must:<\/p>\n

      \n
    • \n

      Be at least 18 years of age<\/p>\n<\/li>\n

    • \n

      Have demonstrable knowledge and experience in astrology, numerology, palmistry, or related fields<\/p>\n<\/li>\n

    • \n

      Complete the application process, including providing accurate personal and professional information<\/p>\n<\/li>\n

    • \n

      Consent to verification procedures, which may include identity verification and credential checks<\/p>\n<\/li>\n<\/ul>\n

      2.2<\/strong>\u00a0We reserve the right to accept or reject any application at our sole discretion.<\/p>\n

      3. INDEPENDENT CONTRACTOR STATUS<\/h3>\n

      3.1<\/strong>\u00a0Astrologers are independent contractors, not employees, partners, or agents of MyMahotsav\u00a0.<\/p>\n

      3.2<\/strong>\u00a0Nothing in this Agreement creates an employment, partnership, joint venture, or agency relationship.<\/p>\n

      3.3<\/strong>\u00a0Astrologers are solely responsible for:<\/p>\n

        \n
      • \n

        Their own taxes, including income tax, GST\/VAT, and any other applicable taxes<\/p>\n<\/li>\n

      • \n

        Their own business expenses, including internet, phone, and equipment<\/p>\n<\/li>\n

      • \n

        Maintaining their own professional liability insurance (recommended)<\/p>\n<\/li>\n<\/ul>\n

        4. ASTROLOGER OBLIGATIONS<\/h3>\n

        4.1<\/strong>\u00a0By providing services on the Platform, Astrologers agree to\u00a0:<\/p>\n

        • \n

          Act with honesty, integrity, and respect toward all clients<\/p>\n<\/li>\n

        • \n

          Offer guidance based on astrological principles and their genuine expertise<\/p>\n<\/li>\n

        • \n

          Refrain from making false claims, predictions, or guarantees about outcomes<\/p>\n<\/li>\n

        • \n

          Not provide medical, financial, or legal advice<\/p>\n<\/li>\n

        • \n

          Maintain confidentiality of client information<\/p>\n<\/li>\n

        • \n

          Respond to client inquiries in a timely manner<\/p>\n<\/li>\n

        • \n

          Comply with all applicable laws and regulations<\/p>\n<\/li>\n<\/ul>\n

          5. PROHIBITED CONDUCT<\/h3>\n

          5.1<\/strong>\u00a0Astrologers may NOT:<\/p>\n

            \n
          • \n

            Guarantee specific outcomes (e.g., “I guarantee you will marry within 6 months”)<\/p>\n<\/li>\n

          • \n

            Claim supernatural powers or abilities beyond astrology<\/p>\n<\/li>\n

          • \n

            Prescribe or recommend any medical treatment<\/p>\n<\/li>\n

          • \n

            Harass, discriminate against, or exploit clients<\/p>\n<\/li>\n

          • \n

            Solicit clients off-platform for private arrangements (to avoid platform fees)<\/p>\n<\/li>\n

          • \n

            Use offensive, abusive, or inappropriate language<\/p>\n<\/li>\n

          • \n

            Share client information with third parties<\/p>\n<\/li>\n<\/ul>\n

            6. FEES AND PAYMENTS<\/h3>\n

            6.1<\/strong>\u00a0Pricing<\/strong>: Astrologers set their own consultation rates, subject to Platform minimums and maximums.<\/p>\n

            6.2<\/strong>\u00a0Revenue Share<\/strong>: Astrologers earn [X]% of consultation fees collected through the Platform. The remaining [Y]% covers platform services, including payment processing, customer acquisition, and support.<\/p>\n

            6.3<\/strong>\u00a0Payout Schedule<\/strong>: Earnings are paid on a [weekly\/monthly] basis, subject to minimum payout thresholds.<\/p>\n

            6.4<\/strong>\u00a0Refunds<\/strong>: If a refund is issued to a client (as provided in the Refund Policy), the corresponding earnings will be deducted from future payouts.<\/p>\n

            7. CLIENT RELATIONSHIP<\/h3>\n

            7.1<\/strong>\u00a0Astrologers are solely responsible for their interactions with clients.<\/p>\n

            7.2<\/strong>\u00a0MyMahotsav is not a party to any consultation and disclaims all liability arising from client-astrologer interactions\u00a0.<\/p>\n

            7.3<\/strong>\u00a0Astrologers must respect client privacy and confidentiality.<\/p>\n

            8. CODE OF CONDUCT<\/h3>\n

            8.1<\/strong>\u00a0Astrologers must adhere to the Astrologer’s Practitioner Code of Conduct (JY-9), which is incorporated by reference.<\/p>\n

            9. TERMINATION<\/h3>\n

            9.1<\/strong>\u00a0By Astrologer<\/strong>: You may terminate this agreement at any time by providing written notice and completing any pending consultations.<\/p>\n

            9.2<\/strong>\u00a0By MyMahotsav<\/strong>: We may suspend or terminate your account for:<\/p>\n

              \n
            • \n

              Breach of these Terms or the Code of Conduct<\/p>\n<\/li>\n

            • \n

              Receipt of multiple client complaints<\/p>\n<\/li>\n

            • \n

              Fraudulent or deceptive conduct<\/p>\n<\/li>\n

            • \n

              Inactivity for an extended period<\/p>\n<\/li>\n

            • \n

              Any reason with 30 days’ notice<\/p>\n<\/li>\n<\/ul>\n

              9.3<\/strong>\u00a0Upon termination, any outstanding earnings will be paid within [thirty (30)] days, subject to deductions for refunds or chargebacks.<\/p>\n

              10. REPRESENTATIONS AND WARRANTIES<\/h3>\n

              10.1<\/strong>\u00a0Astrologers represent and warrant that\u00a0:<\/p>\n

                They have the right and authority to enter this Agreement<\/p>\n<\/li>\n

              • \n

                All information provided is accurate and complete<\/p>\n<\/li>\n

              • \n

                Their services comply with all applicable laws<\/p>\n<\/li>\n

              • \n
