Your Agreement When Booking a Venue<\/h3>\n

This document explains the terms that apply when you book a venue through Utsav Venues\u2122. Please read it carefully\u2014it affects your rights and responsibilities.<\/p>\n

The Simple Truth<\/h3>\n

  • \n

    Your Contract is With the Host<\/strong>: When you book, you’re entering into a rental agreement directly with the venue host. We facilitate the transaction but aren’t a party to your rental contract\u00a0.<\/p>\n<\/li>\n

  • \n

    Read the Listing Carefully<\/strong>: Hosts provide detailed information about their venues. Make sure you understand the space, rules, and cancellation policy before booking.<\/p>\n<\/li>\n

  • \n

    Cancellation Terms Vary<\/strong>: Each host selects their own cancellation policy. Check it before you book\u2014it affects your refund rights\u00a0.<\/p>\n<\/li>\n

  • \n

    You’re Responsible for Your Event<\/strong>: You’re responsible for your guests’ behavior, compliance with house rules, and any damage caused.<\/p>\n<\/li>\n

  • \n

    Insurance Recommended<\/strong>: While hosts carry liability insurance, you may want your own event insurance for cancellations or other contingencies\u00a0.<\/p>\n<\/li>\n<\/ul>\n

    Part B: Legal Terms and Conditions<\/h2>\n

    1. RENTER STATUS AND RELATIONSHIP<\/h3>\n

    1.1<\/strong>\u00a0Independent Relationship<\/strong>: When you book a Venue through the Platform, you enter into a direct contractual relationship with the Host. MyMahotsav is not a party to this agreement\u00a0.<\/p>\n

    1.2<\/strong>\u00a0No Agency<\/strong>: MyMahotsav does not act as an agent for any Host. We provide the technology platform that facilitates your transaction.<\/p>\n

    2. ELIGIBILITY<\/h3>\n

    2.1<\/strong>\u00a0Age Requirement<\/strong>: You must be at least 18 years old to book a Venue. By making a Booking, you represent and warrant that you are at least 18\u00a0.<\/p>\n

    2.2<\/strong>\u00a0Authority<\/strong>: If you are booking on behalf of an organization or company, you represent that you have the authority to bind that entity.<\/p>\n

    3. BOOKING PROCESS<\/h3>\n

    3.1<\/strong>\u00a0Search and Selection<\/strong>: You may search for Venues based on location, dates, capacity, amenities, and other criteria. Listings provide information about the Venue, including descriptions, images, pricing, and house rules.<\/p>\n

    3.2<\/strong>\u00a0Booking Request<\/strong>:<\/p>\n

      For\u00a0Instant Book<\/strong>\u00a0listings: Your Booking is confirmed immediately upon payment.<\/p>\n<\/li>\n

    • \n

      For\u00a0Request-Based<\/strong>\u00a0listings: You submit a booking request; the Host has [24 hours] to approve or decline. If approved, your Booking is confirmed. If declined or if the Host doesn’t respond, any payment held will be refunded.<\/p>\n<\/li>\n<\/ul>\n

      3.3<\/strong>\u00a0Booking Confirmation<\/strong>: Once confirmed, you will receive a confirmation email with details of your Booking. This confirmation constitutes your rental agreement with the Host\u00a0.<\/p>\n

      4. PAYMENT<\/h3>\n

      4.1<\/strong>\u00a0Total Price<\/strong>: The total price displayed at checkout includes\u00a0:<\/p>\n

        Venue rental fee<\/p>\n<\/li>\n

      • \n

        Applicable taxes (GST, VAT, sales tax)<\/p>\n<\/li>\n

      • \n

        Platform service fees<\/p>\n<\/li>\n

      • \n

        Any additional fees disclosed by the Host (cleaning, security, etc.)<\/p>\n<\/li>\n<\/ul>\n

        4.2<\/strong>\u00a0Payment Methods<\/strong>: We accept various payment methods as displayed during checkout. Payment is processed through our secure third-party payment partners.<\/p>\n

        4.3<\/strong>\u00a0Authorization<\/strong>: By completing a Booking, you authorize us to charge the total amount to your selected payment method.<\/p>\n

        5. CANCELLATION AND REFUNDS<\/h3>\n

        5.1<\/strong>\u00a0Host Cancellation Policy<\/strong>: Each listing displays the Host’s selected cancellation policy. Your refund rights depend on this policy and the timing of cancellation\u00a0.<\/p>\n

        5.2<\/strong>\u00a0Standard Cancellation Tiers<\/strong>:<\/p>\n

        5.3<\/strong>\u00a0Renter-Initiated Cancellation<\/strong>: To cancel a Booking, log into your account and follow the cancellation process. Refunds, if any, will be processed according to the applicable policy.<\/p>\n

        5.4<\/strong>\u00a0Host-Initiated Cancellation<\/strong>: If a Host cancels your Booking (except for force majeure), you will receive a full refund. You may also be eligible for additional assistance as described in our Rebooking Policy.<\/p>\n

        5.5<\/strong>\u00a0Force Majeure<\/strong>: If a Booking is cancelled due to force majeure events beyond anyone’s control, refunds will be handled as described in the Deposit Policy (VV-4)\u00a0.<\/p>\n

        6. RENTER RESPONSIBILITIES<\/h3>\n

        6.1<\/strong>\u00a0Compliance with House Rules<\/strong>: You agree to comply with all house rules established by the Host, including\u00a0:<\/p>\n

          Occupancy limits<\/p>\n<\/li>\n

        • \n

          Noise restrictions and curfews<\/p>\n<\/li>\n

        • \n

          Rules regarding alcohol, smoking, and decorations<\/p>\n<\/li>\n

          Parking and loading instructions<\/p>\n<\/li>\n

        • \n

          Check-in and check-out procedures<\/p>\n<\/li>\n<\/ul>\n

          6.2<\/strong>\u00a0Guest Conduct<\/strong>: You are responsible for the conduct of all guests attending your event. You agree to ensure that your guests comply with house rules and applicable laws.<\/p>\n

          6.3<\/strong>\u00a0Damage Responsibility<\/strong>: You are responsible for any damage to the Venue caused by you or your guests during your event, beyond normal wear and tear\u00a0.<\/p>\n

          6.4<\/strong>\u00a0Legal Compliance<\/strong>: You agree to comply with all applicable laws, including:<\/p>\n

            Alcohol licensing laws (if serving alcohol)<\/p>\n<\/li>\n

          • \n

            Noise regulations<\/p>\n<\/li>\n

          • \n

            Age restrictions (if applicable)<\/p>\n<\/li>\n

          • \n

            Fire safety requirements<\/p>\n<\/li>\n<\/ul>\n

            7. DAMAGE CLAIMS PROCESS<\/h3>\n

            7.1<\/strong>\u00a0Damage Assessment<\/strong>: If the Host believes damage has occurred, they must notify you and the Platform within [3] days of the event, providing evidence (photos, receipts).<\/p>\n

            7.2<\/strong>\u00a0Resolution<\/strong>: You and the Host may attempt to resolve the matter directly. If unresolved, claims may be submitted through our dispute resolution process or deducted from any security deposit held\u00a0.<\/p>\n

            7.3<\/strong>\u00a0Liability<\/strong>: You remain liable for damage even if it exceeds any security deposit held.<\/p>\n

            8. INSURANCE<\/h3>\n

            8.1<\/strong>\u00a0Host Insurance<\/strong>: Hosts are required to carry public liability insurance. However, this insurance is primarily for the Host’s protection and may not cover your claims\u00a0.<\/p>\n

            8.2<\/strong>\u00a0Your Insurance<\/strong>: We strongly recommend that you consider purchasing event insurance to cover\u00a0:<\/p>\n

              Event cancellation for reasons beyond your control<\/p>\n<\/li>\n

            • \n

              Personal injury to you or your guests<\/p>\n<\/li>\n

            • \n

              Damage to your property or equipment<\/p>\n<\/li>\n

              Liability for third-party claims<\/p>\n<\/li>\n<\/ul>\n

              9. REVIEWS<\/h3>\n

              9.1<\/strong>\u00a0Honest Reviews<\/strong>: You may leave reviews of Venues you have booked. Reviews must be honest, based on actual experience, and not retaliatory.<\/p>\n

              9.2<\/strong>\u00a0Review Guidelines<\/strong>: Reviews may not contain:<\/p>\n

                Profanity or abusive language<\/p>\n<\/li>\n

              • \n

                Personal attacks<\/p>\n<\/li>\n

              • \n

                False or misleading statements<\/p>\n<\/li>\n

              • \n

                Confidential information<\/p>\n<\/li>\n<\/ul>\n

                10. DISPUTE RESOLUTION<\/h3>\n

                10.1<\/strong>\u00a0Direct Resolution<\/strong>: In case of any dispute with a Host, you agree to first attempt to resolve the matter directly with the Host.<\/p>\n

                10.2<\/strong>\u00a0Platform Mediation<\/strong>: If direct resolution fails, you may request Platform mediation by contacting\u00a0disputes@utsavvenues.com. We will facilitate communication but are not a decision-maker.<\/p>\n

                10.3<\/strong>\u00a0Legal Action<\/strong>: Disputes not resolved through mediation may be pursued through the legal process described in the Platform Terms of Service<\/p>\n","protected":false},"excerpt":{"rendered":"
