Your Agreement as a Freelancer on Utsav Works\u2122<\/h3>\n

This document explains the specific terms that apply when you bid on projects, deliver work, and get paid through our platform.<\/p>\n

The Simple Truth<\/h3>\n
    \n
  • \n

    You’re an Independent Business<\/strong>: You run your own business. We’re not your employer\u2014you’re responsible for your taxes, insurance, and business expenses .<\/p>\n<\/li>\n

  • \n

    Bids Are Binding<\/strong>: When you bid on a project and are selected, you’re committing to deliver the work as described .<\/p>\n<\/li>\n

  • \n

    Escrow Protects Your Payment<\/strong>: Client funds are held securely and released when you deliver approved work. You’re guaranteed payment for approved work .<\/p>\n<\/li>\n

  • \n

    Communicate on Platform<\/strong>: Keep all project discussions on the platform\u2014if disputes arise, we can only see what happened here .<\/p>\n<\/li>\n

  • \n

    You Assign IP Upon Payment<\/strong>: When you get paid, the client owns the work product (unless you agree otherwise) .<\/p>\n<\/li>\n<\/ul>\n

    Part B: Legal Terms and Conditions<\/h2>\n

    2. FREELANCER STATUS AND RESPONSIBILITIES<\/h3>\n

    2.1<\/strong>\u00a0Independent Contractor<\/strong>: Freelancers are independent contractors, not employees, partners, or agents of MyMahotsav or Clients .<\/p>\n

    2.2<\/strong>\u00a0Sole Responsibility<\/strong>: Freelancers are solely responsible for :<\/p>\n

    • \n

      Their own taxes, including income tax, GST\/VAT, and self-employment taxes<\/p>\n<\/li>\n

    • \n

      Their own business expenses, insurance, and benefits<\/p>\n<\/li>\n

    • \n

      Complying with all applicable laws and regulations<\/p>\n<\/li>\n

    • \n

      Determining their work methods and schedule<\/p>\n<\/li>\n

    • \n

      Delivering work in accordance with Service Contracts<\/p>\n<\/li>\n<\/ul>\n

      2.3<\/strong>\u00a0No Employee Benefits<\/strong>: Freelancers are not entitled to any employee benefits, workers’ compensation, unemployment insurance, or other benefits from MyMahotsav or Clients .<\/p>\n

      3. FREELANCER ELIGIBILITY<\/h3>\n

      3.1<\/strong>\u00a0To become a Freelancer, you must :<\/p>\n

      • \n

        Be at least 18 years old<\/p>\n<\/li>\n

      • \n

        Complete identity verification (government ID, address verification)<\/p>\n<\/li>\n

      • \n

        Provide accurate profile information<\/p>\n<\/li>\n

      • \n

        Have the legal right to provide services in your jurisdiction<\/p>\n<\/li>\n<\/ul>\n

        4. BIDDING ON PROJECTS<\/h3>\n

        4.1<\/strong>\u00a0Bid Requirements<\/strong>: When submitting a bid, you must provide :<\/p>\n

        Approach<\/strong><\/td>\nBrief description of how you’ll complete the work<\/td>\n<\/tr>\n
        Relevant Experience<\/strong><\/td>\nWhy you’re qualified for this project<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<\/div>\n

        4.2<\/strong>\u00a0Accuracy<\/strong>: You represent that all bid information is accurate. Knowingly submitting false or misleading bids may result in account suspension .<\/p>\n

        4.3<\/strong>\u00a0Binding Nature<\/strong>: If a Client accepts your bid, you are contractually obligated to perform the work as described in your bid and any subsequent agreed-upon specifications .<\/p>\n

        4.4<\/strong>\u00a0No Guarantee of Selection<\/strong>: Submitting a bid does not guarantee you will be selected for the project.<\/p>\n

        5. PROJECT ACCEPTANCE AND COMMENCEMENT<\/h3>\n

        5.1<\/strong>\u00a0Service Contract Formation<\/strong>: When a Client accepts your bid and funds are deposited into escrow, a binding Service Contract is formed directly between you and the Client .<\/p>\n

        5.2<\/strong>\u00a0Confirmation<\/strong>: You will receive notification when funds are in escrow. Upon notification, you may begin work.<\/p>\n

        5.3<\/strong>\u00a0No Work Without Escrow<\/strong>: You must not commence work until funds are confirmed in escrow. Work performed without escrow funding is at your own risk and may not be eligible for payment protection .<\/p>\n

        6. PROJECT DELIVERY<\/h3>\n

        6.1<\/strong>\u00a0Submission<\/strong>: Upon completing work (or a milestone), you must submit deliverables through the Platform.<\/p>\n

        6.2<\/strong>\u00a0Review Period<\/strong>: The Client has [7] days to review deliverables and either:<\/p>\n

        • \n

          Approve and release payment<\/p>\n<\/li>\n

        • \n

          Request revisions<\/p>\n<\/li>\n

        • \n

          Reject with explanation<\/p>\n<\/li>\n

        • \n

          Initiate dispute<\/p>\n<\/li>\n<\/ul>\n

          6.3<\/strong>\u00a0Automatic Approval<\/strong>: If the Client fails to respond within the review period, the work may be deemed approved and payment released .<\/p>\n

          6.4<\/strong>\u00a0Revisions<\/strong>: If revisions are requested, you agree to make reasonable efforts to address Client feedback. Excessive or unreasonable revision requests may be subject to dispute resolution.<\/p>\n

          7. PAYMENT<\/h3>\n

          7.1<\/strong>\u00a0Payment Release<\/strong>: Upon Client approval (or automatic approval), payment is released from escrow to your account.<\/p>\n

          7.2<\/strong>\u00a0Payout Schedule<\/strong>: Funds are available for withdrawal according to our payout schedule (typically [3-5] business days after release).<\/p>\n

          7.3<\/strong>\u00a0Platform Fees<\/strong>: Applicable platform commissions are deducted before payment is released to you .<\/p>\n

          7.4<\/strong>\u00a0Currency Conversion<\/strong>: If you receive payments in a different currency, your bank may apply conversion fees.<\/p>\n

          8. WITHDRAWAL AND CANCELLATION<\/h3>\n

          8.1<\/strong>\u00a0Withdrawal Before Acceptance<\/strong>: If you withdraw a bid before Client acceptance, no obligations arise.<\/p>\n

          8.2<\/strong>\u00a0Cancellation During Project<\/strong>: If you need to cancel an active project:<\/p>\n

          • \n

            Notify the Client immediately through the Platform<\/p>\n<\/li>\n

          • \n

            You are entitled to payment for completed, approved work<\/p>\n<\/li>\n

          • \n

            Unearned escrowed funds will be refunded to Client<\/p>\n<\/li>\n

          • \n

            Excessive cancellations may affect your standing<\/p>\n<\/li>\n<\/ul>\n

            9. INTELLECTUAL PROPERTY<\/h3>\n

            9.1<\/strong>\u00a0Default IP Assignment<\/strong>: Upon full payment, you assign all rights, title, and interest in the work product to the Client, including copyright and other intellectual property rights .<\/p>\n

            9.2<\/strong>\u00a0Exceptions<\/strong>: If different IP arrangements are needed (e.g., you retain ownership and grant a license), you must specify this in your bid and the Service Contract.<\/p>\n

            9.3<\/strong>\u00a0Third-Party Materials<\/strong>: If you use third-party materials (images, fonts, code libraries), you must ensure you have appropriate licenses that allow the Client to use them.<\/p>\n

            9.4<\/strong>\u00a0Portfolio Rights<\/strong>: Unless the Client agrees otherwise, you may display work in your portfolio after project completion and payment.<\/p>\n

            10. FREELANCER OBLIGATIONS AND WARRANTIES<\/h3>\n

            10.1<\/strong>\u00a0By using the Platform as a Freelancer, you represent and warrant that :<\/p>\n

              You have the skill and expertise to perform the services you offer<\/p>\n<\/li>\n

            • \n

              You will perform work in a professional and timely manner<\/p>\n<\/li>\n

            • \n

              Your work will be original and not infringe third-party rights<\/p>\n<\/li>\n

            • \n

              You will comply with all applicable laws<\/p>\n<\/li>\n

            • \n

              You will communicate professionally with Clients<\/p>\n<\/li>\n

            • \n

              You will not subcontract work without Client consent<\/p>\n<\/li>\n<\/ul>\n

              11. RATINGS AND REVIEWS<\/h3>\n

              11.1<\/strong>\u00a0You may receive ratings and reviews from Clients after project completion.<\/p>\n

              11.2<\/strong>\u00a0Maintaining high ratings and positive reviews is important for your success on the Platform.<\/p>\n

              11.3<\/strong>\u00a0Review manipulation (e.g., fake reviews, reciprocal positive reviews) is prohibited .<\/p>\n","protected":false},"excerpt":{"rendered":"
