Part A: Plain English Summary<\/h2>\n

Your Agreement as a Volunteer<\/h3>\n

This document outlines the understanding between you (the volunteer) and the organization you’ll be serving. It covers important legal matters including safety, liability, and your role.<\/p>\n

The Simple Truth<\/h3>\n

    You Are a Volunteer, Not an Employee<\/strong>: You will not receive payment, benefits, or employment rights from your volunteer service\u00a0.<\/p>\n<\/li>\n

  • \n

    Volunteering Has Risks<\/strong>: All activities carry some inherent risk. By volunteering, you acknowledge and accept these risks\u00a0.<\/p>\n<\/li>\n

  • \n

    You Release the Organization from Liability<\/strong>: If you are injured while volunteering, you generally agree not to sue the organization (this is standard practice)\u00a0.<\/p>\n<\/li>\n

  • \n

    Confidentiality Matters<\/strong>: You may learn private information\u2014keep it confidential\u00a0.<\/p>\n<\/li>\n

  • \n

    Follow Safety Rules<\/strong>: Always follow instructions and use provided safety equipment\u00a0.<\/p>\n<\/li>\n<\/ul>\n

    \n

    Part B: Volunteer Service Agreement<\/h2>\n

    1. PARTIES AND STATUS<\/h3>\n

    1.1<\/strong>\u00a0Agreement<\/strong>: This Volunteer Service Agreement (“Agreement”) is entered into between the Organization posting the volunteer opportunity and the Volunteer accepting the position.<\/p>\n

    1.2<\/strong>\u00a0Independent Volunteer Status<\/strong>: The Volunteer is participating as a volunteer and not as an employee of the Organization. Nothing in this Agreement shall be construed as creating a partnership, employment, internship, or agency relationship\u00a0.<\/p>\n

    1.3<\/strong>\u00a0No Compensation<\/strong>: The Volunteer will not receive any financial remuneration, salary, wage, payment, or any employee benefit whatsoever for their services\u00a0.<\/p>\n

    1.4<\/strong>\u00a0No Employment Rights<\/strong>: The Volunteer will not be accorded any employment rights by the Organization and is not entitled to workers’ compensation coverage unless otherwise provided by law\u00a0.<\/p>\n

    2. VOLUNTEER RESPONSIBILITIES<\/h3>\n

    2.1<\/strong>\u00a0Scope of Services<\/strong>: The Volunteer agrees to perform the duties and tasks described in the Job Posting or as reasonably assigned by the Organization\u00a0.<\/p>\n

    2.2<\/strong>\u00a0Performance Standards<\/strong>: The Volunteer agrees to\u00a0:<\/p>\n

      \n
    • \n

      Perform all tasks to the best of their ability<\/p>\n<\/li>\n

    • \n

      Follow all instructions given by Organization staff or supervisors<\/p>\n<\/li>\n

    • \n

      Observe all safety rules and use provided safety equipment<\/p>\n<\/li>\n

    • \n

      Not operate equipment or tools without proper training and authorization<\/p>\n<\/li>\n

    • \n

      Notify their supervisor immediately of any injury incurred while volunteering<\/p>\n<\/li>\n<\/ul>\n

      2.3<\/strong>\u00a0Time Commitment<\/strong>: The Volunteer agrees to meet the time commitments agreed upon and to provide reasonable notice if unable to fulfill scheduled commitments\u00a0.<\/p>\n

      2.4<\/strong>\u00a0Confidentiality<\/strong>: The Volunteer agrees to maintain the confidentiality of any personal or sensitive information learned during their volunteer service and not to use such information for personal or commercial benefit\u00a0.<\/p>\n

      3. ACKNOWLEDGMENT AND ASSUMPTION OF RISKS<\/h3>\n

      3.1<\/strong>\u00a0Inherent Risks<\/strong>: The Volunteer acknowledges that participation in volunteer activities involves certain elements of risk. These risks may result from\u00a0:<\/p>\n

      • \n

        The nature of the activities themselves<\/p>\n<\/li>\n

      • \n

        Natural and manmade conditions<\/p>\n<\/li>\n

      • \n

        Climatic conditions<\/p>\n<\/li>\n

      • \n

        The actions of third parties<\/p>\n<\/li>\n

      • \n

        The Volunteer’s own physical condition and actions<\/p>\n<\/li>\n<\/ul>\n

        3.2<\/strong>\u00a0Assumption of Risk<\/strong>: The Volunteer freely accepts and fully assumes all risks, dangers, and hazards resulting from their participation, including economic loss, personal injury, death, or damage to property\u00a0.<\/p>\n

        3.3<\/strong>\u00a0Health and Safety<\/strong>: The Volunteer represents that they are physically capable of performing the volunteer duties and have no health conditions that would make participation unsafe.<\/p>\n

        3.4<\/strong>\u00a0Medical Treatment Consent<\/strong>: In the event of injury, the Volunteer consents to receiving first aid or medical treatment from the Organization or its representatives and waives claims arising from such treatment\u00a0.<\/p>\n

        4. RELEASE OF LIABILITY AND WAIVER OF CLAIMS<\/h3>\n

        4.1<\/strong>\u00a0Release<\/strong>: The Volunteer releases the Organization and its employees, officers, directors, agents, and assigns (collectively, “Releasees”) from any and all claims for personal injury, property damage, or any other loss that may arise from or be in any way connected to the Volunteer’s participation\u00a0.<\/p>\n

        4.2<\/strong>\u00a0Waiver<\/strong>: The Volunteer waives any right to bring any claim or action against the Releasees for any injury or damage arising from volunteer activities.<\/p>\n

        4.3<\/strong>\u00a0Binding Effect<\/strong>: This release applies to both present and future injuries and binds the Volunteer’s heirs, executors, and administrators\u00a0.<\/p>\n

        5. INDEMNIFICATION<\/h3>\n

        5.1<\/strong>\u00a0Indemnity<\/strong>: The Volunteer agrees to indemnify and hold harmless the Releasees from any claims, damages, or expenses arising from the Volunteer’s acts or omissions during volunteer service\u00a0.<\/p>\n

        6. INSURANCE<\/h3>\n

        6.1<\/strong>\u00a0No Coverage<\/strong>: The Volunteer acknowledges that they are not covered by any disability, accident, or medical insurance provided by the Organization\u00a0.<\/p>\n

        6.2<\/strong>\u00a0Personal Insurance<\/strong>: The Volunteer is encouraged to maintain their own health, accident, and liability insurance coverage.<\/p>\n

        7. PHOTO AND MEDIA RELEASE<\/h3>\n

        7.1<\/strong>\u00a0Consent<\/strong>: The Volunteer grants the Organization permission to use photographs, videos, or audio recordings taken during volunteer activities for promotional, educational, or organizational purposes\u00a0.<\/p>\n

        7.2<\/strong>\u00a0Opt-Out<\/strong>: Volunteers who do not wish to be photographed should make this known to the Organization in writing at the time of service\u00a0.<\/p>\n

        8. TERMINATION<\/h3>\n

        8.1<\/strong>\u00a0At-Will Relationship<\/strong>: Either the Volunteer or the Organization may terminate the volunteer relationship at any time, with or without cause, by providing notice\u00a0.<\/p>\n

        8.2<\/strong>\u00a0Return of Property<\/strong>: Upon termination, the Volunteer agrees to return all Organization equipment, keys, documents, and property\u00a0.<\/p>\n

        9. GENERAL PROVISIONS<\/h3>\n

        9.1<\/strong>\u00a0Entire Agreement<\/strong>: This Agreement constitutes the entire understanding between the parties regarding volunteer service.<\/p>\n

        9.2<\/strong>\u00a0Severability<\/strong>: If any provision of this Agreement is found invalid, the remainder shall continue in full force and effect\u00a0.<\/p>\n

        9.3<\/strong>\u00a0Governing Law<\/strong>: This Agreement shall be governed by the laws of the jurisdiction where the volunteer activities take place.<\/p>\n

        9.4<\/strong>\u00a0Acknowledgement<\/strong>: By signing this Agreement, the Volunteer acknowledges that they have read, understood, and agree to its terms and are signing voluntarily\u00a0.<\/p>\n

        \n

        Part C: Minor Volunteer Provisions<\/h2>\n

        C.1<\/strong>\u00a0Volunteers under 18 years of age must have this Agreement signed by a parent or legal guardian\u00a0.<\/p>\n

        C.2<\/strong>\u00a0The parent or guardian agrees to all terms on behalf of the minor and accepts full responsibility for the minor’s participation.<\/p>\n

        C.3<\/strong>\u00a0Organizations working with minors may have additional requirements, including background checks and supervision ratios.<\/p>\n","protected":false},"excerpt":{"rendered":"
