Part A: Plain English Summary #

What This Agreement Does #

This agreement governs your submission of photos, videos, audio recordings, and other media files to Utsav World™.

The Simple Truth #

You own your media: Submitting doesn’t transfer ownership. It’s still yours.
We need permission: To show your media on our platform, you give us a license. This license is broad enough to let us operate the service.
You represent it’s yours: By submitting, you confirm you have the right to do so—you took the photo, you have permission from people visible in it, etc.
We can say no: We reserve the right to reject, not publish, or remove any submission for any reason.
We don’t pay for submissions: This is for user-generated content, not commissioned work.

Part B: Legal Terms and Conditions #

1. Definitions #

1.1 In addition to definitions in the General Terms, in this Agreement:

Media means photographs, digital images, illustrations, graphics, audio recordings, video recordings, audiovisual works, animations, and any other non-text content files.
Submission means the act of uploading, transmitting, or otherwise making Media available to the Platform.
Editorial Use means use for news, commentary, criticism, educational, or cultural heritage purposes.
Commercial Use means use for advertising, marketing, merchandising, or other revenue-generating purposes not covered under Editorial Use.

2. Grant of Rights #

2.1 By Submitting Media to the Platform, you grant MyMahotsav Futuretech Ltd a non-exclusive, worldwide, royalty-free, sub-licensable, transferable license to:

(a) Host, store, cache, and maintain the Media on Platform infrastructure
(b) Display, perform, and distribute the Media through Platform services
(c) Modify, adapt, or format the Media solely for technical compatibility with Platform systems
(d) Create thumbnails, previews, excerpts, and derivative indexing formats
(e) Translate, caption, or provide accessibility adaptations
(f) Use Media for Platform marketing and promotional purposes, with attribution as provided in the Attribution Guidelines

2.2 The license granted in Section 2.1:

Continues until you delete the Media or close your Account, subject to Section 7 (Archival and Backup)
Does not transfer ownership or exclusive rights
Does not entitle you to compensation unless separate written agreement exists

2.3 Utsav World™ does not claim ownership of your Media. You retain all rights not expressly granted.

3. Representations and Warranties #

3.1 You represent and warrant that:

(a) You own all rights in the Media or have obtained all necessary licenses, permissions, and consents
(b) All persons depicted in the Media have provided written consent for the uses contemplated in this Agreement
(c) For Media depicting minors under 18 (or age of majority in applicable jurisdiction), you have obtained verifiable parental/guardian consent
(d) The Media does not infringe any third-party copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or other intellectual or proprietary right
(e) The Media does not contain malware, spyware, viruses, or other harmful code
(f) The Media complies with all Platform Policies and applicable laws

3.2 You agree to indemnify and hold Utsav World™ harmless from any claims arising from breach of these warranties.

4. Model Releases and Property Releases #

4.1 Recognizable Individuals: If Media depicts a recognizable individual, you represent that you have obtained a signed model release permitting the uses under this Agreement.

4.2 Private Property: If Media depicts privately-owned property not ordinarily visible from public spaces, you represent you have obtained necessary permission.

4.3 Religious/Cultural Sensitivity: Media depicting religious ceremonies, sacred spaces, or cultural practices must be submitted with appropriate contextual respect and any required permissions from religious authorities.

4.4 Utsav World™ may request copies of any releases at any time. Failure to provide requested releases within 7 days may result in Media removal.

5. Deletion and Retention #

5.1 When you delete Media from the Platform:

It will no longer be publicly accessible within a reasonable timeframe
Backups may retain copies for up to 90 days
Archival copies for cultural preservation purposes may be retained per the Archival Use Rights Policy

5.2 Utsav World™ is not responsible for maintaining copies of Media you delete. You should maintain your own backup copies.

Part C: Jurisdiction-Specific Addendums #

India Addendum #

Data Protection: Media containing personal data is processed under applicable Indian data protection laws. See Privacy Policy for retention periods and rights.

IT Act Compliance: Media submissions are subject to the Information Technology Act, 2000 and Intermediary Guidelines Rules, 2021 . Utsav World™ will designate a Grievance Officer for takedown requests.

UK/EU Addendum #

GDPR Compliance: Media containing personal data is processed under GDPR/UK GDPR. You have the right to erasure subject to Platform verification.

US Addendum #

Section 230: Utsav World™ is a provider of interactive computer services and does not create or develop Media content. We are not deemed a publisher or speaker of User Media under 47 U.S.C. § 230.
