Part A: Plain English Summary #

When You Appear in Content on Utsav World™ #

This policy explains how we handle your image, voice, and likeness when you appear in photos, videos, or live streams posted by other users.

The Simple Truth #

You have privacy rights: Your image and likeness are protected by law.
Consent is required: Users should get your permission before posting content that features you.
If you’re in public: At public events, there’s a lower expectation of privacy.
You can request removal: If someone posts content featuring you without consent, you can ask for it to be removed.
We’re not responsible for other users: We provide tools to report violations, but users are responsible for getting consent.

Part B: Legal Terms and Conditions #

1. Definitions #

Term	Definition
Likeness	Your identifiable image, voice, or appearance captured in Content
Public Figure	An individual who has achieved prominence or who voluntarily participates in public events
Public Space	A location where there is no reasonable expectation of privacy
Commercial Use	Use of Likeness for advertising, marketing, or promotional purposes

2.1 Before posting Content that depicts another identifiable individual, Users must obtain consent from that individual, unless:

The individual is a public figure in a public space
The Content is newsworthy or in the public interest
The individual is part of a crowd and not the focus of the Content

2.2 For Content depicting minors, consent must be obtained from a parent or legal guardian.

2.3 Consent must be:

Informed (the individual knows how the Content will be used)
Voluntary (not obtained through coercion)
Documented (written or electronic record)

3. Your Rights as an Individual Depicted #

3.1 If you are depicted in Content without your consent, you have the right to:

Request removal of the Content
Object to specific uses (particularly commercial uses)
Report violations to Utsav World™

3.2 Utsav World™ will review removal requests and may remove Content that:

Was posted without required consent
Violates privacy laws
Constitutes harassment or stalking

4. Public Events and Spaces #

4.1 When you attend public events or enter public spaces:

You may be photographed or filmed by others
Your expectation of privacy is reduced
Organizers may have photography policies (see Utsav Pass™ policies)

4.2 Utsav World™ is not responsible for:

Photography by other users in public spaces
Content posted from public events
Failure of users to obtain consent

5. Commercial Use of Likeness #

5.1 If Utsav World™ wishes to use your Likeness for commercial purposes (advertising, promotion):

We will obtain separate, specific consent
You may be entitled to compensation (terms to be agreed separately)
You may withdraw consent at any time (commercial use will cease)

5.2 Commercial use does not include:

Standard Platform operations (displaying Content as intended)
Algorithmic recommendations
Non-promotional uses

India Addendum #

Right to Privacy: The Supreme Court of India has recognized privacy as a fundamental right under Article 21. Unauthorized use of likeness may violate this right.
