Links, Files, and Content from Outside Utsav Messenger™ #

When you share links, files, or other content from outside Utsav Messenger™, that content comes from third parties—not from us. This policy explains our role and your responsibilities.

The Simple Truth #

• We don’t control external content: If someone shares a link to another website, that site’s content is not ours.

• We’re not responsible for what’s out there: We can’t guarantee the safety, accuracy, or legality of external websites.

• Be careful what you click: Links can lead to scams, malware, or inappropriate content.

• We do try to protect you: We may warn about suspicious links or block known bad sites.

• Report harmful links: If you see malicious content, report it so we can warn others.

2.1 Utsav Messenger™ is a platform for communication. When users share links or files:

• We are acting as a conduit for information

• We do not create, develop, or endorse External Content

• We do not control or monitor External Content proactively

2.2 Intermediary Status:

• Utsav Messenger™ qualifies for intermediary liability protections under applicable laws (Section 79 India IT Act, Section 230 US CDA, eCommerce Directive EU)

• We are not the publisher or speaker of External Content

3. Disclaimer of Liability #

3.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, UTSAV MESSENGER™ AND MYMAHOTSAV FUTURETECH LTD DISCLAIM ALL LIABILITY FOR:

• Any External Content accessed through links shared on the Platform

• Any damages resulting from access to or reliance on External Content

• Any loss or corruption of data from external downloads

• Any financial loss from transactions on external sites

• Any offensive, illegal, or harmful content on external sites

3.2 This disclaimer applies even if:

• We provide warnings about links

• We have previously removed similar content

• We are aware of the existence of such content

4. No Warranty for External Content #

4.1 External Content is provided “as is” without warranties of:

• Accuracy or reliability

• Safety or security

• Legality

• Freedom from viruses or malware

5.1 By using Utsav Messenger™, you acknowledge and agree that:

• You are responsible for your own decisions to access External Content

• You should exercise caution when clicking links

• You should verify the authenticity of links before clicking

• You are solely responsible for any consequences of accessing External Content

5.2 Best Practices:

• Hover over links to see actual URL

• Verify sender before clicking unusual links

• Don’t download files from unknown sources

• Keep antivirus software updated

• Never enter passwords on suspicious sites

6. Our Protective Measures #

6.1 Although we are not liable, we voluntarily implement safety measures:

• Your reliance on External Content

Part C: Jurisdiction-Specific Addendums #

India Addendum #

IT Act, 2000 – Section 79: Intermediaries are not liable for third-party information if they:

• Do not initiate the transmission

• Do not select the receiver

• Do not select or modify the information

IT Rules, 2021: Due diligence requires taking down certain content upon actual knowledge.

UK/EU Addendum #

eCommerce Directive – Article 12-14: Mere conduit, caching, and hosting protections.

Digital Services Act: Enhanced due diligence for very large platforms, but intermediary protections maintained.

US Addendum #

Section 230(c)(1) : “No provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider.”

Section 230(c)(2) : Protection for good faith content moderation.
