Part A: Plain English Summary #

Welcome to GyanVapy Wiki™! #

GyanVapy Wiki™ is a collaborative knowledge base dedicated to festivals, culture, faith, and rituals. Think of it as a living library built by the community, for the community. Anyone can read it, and registered users can contribute and improve its content.

The Simple Truth #

• A Living Community Project: The content on GyanVapy Wiki™ is created, edited, and moderated by a global community of volunteers. It is not written by MyMahotsav.

• We Don’t Verify Everything: While we have guidelines and moderators, we cannot guarantee the complete accuracy, completeness, or religious orthodoxy of every article. Information is provided for general knowledge and should be independently verified.

• You Are Responsible for Your Edits: If you contribute, you are responsible for ensuring your additions are accurate, respectful, and do not violate anyone’s rights.

• Respect is Mandatory: This is a space for learning and sharing. Harassment, vandalism, and the promotion of hatred are strictly forbidden.

• We Can’t Be Sued for User Content: As a platform, our legal protection relies on promptly addressing reported violations. We are not the “publisher” of user-generated content.

Part B: Legal Terms and Conditions #

1. Introduction and Acceptance #

1.1 These GyanVapy Wiki™ Terms of Use (“Wiki Terms”) govern your access to and use of the GyanVapy Wiki™ website and services.

1.2 By accessing, browsing, or contributing to GyanVapy Wiki™, you agree to be bound by these Wiki Terms and all other policies incorporated by reference, including our Privacy Policy and Acceptable Use Policy.

1.3 If you are using the wiki on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. The GyanVapy Wiki™ Community and Platform Role #

2.1 GyanVapy Wiki™ is a collaborative platform. The content is created and edited by users (“Contributors”).

2.2 Platform Role: MyMahotsav Futuretech Ltd provides the technology platform, hosting, and administrative framework. We are not the author, publisher, or endorser of any user-generated content.

2.3 No Editorial Control: We do not actively monitor, screen, or review every contribution before publication. We rely on our community and moderation systems to identify and address content that violates our policies.

2.4 Intermediary Status: GyanVapy Wiki™ qualifies for intermediary liability protections under applicable laws, including Section 79 of India’s Information Technology Act, 2000, and Section 230 of the US Communications Decency Act. Our liability is limited as provided for in such laws, provided we comply with prescribed due diligence requirements.

3. Your Contributions and Conduct #

3.1 Eligibility: You must be at least 13 years old to contribute. If you are between 13 and 18, you confirm you have parental permission to do so.

3.2 Account Responsibility: You are responsible for all edits made from your account. Keep your password secure and immediately notify us of any unauthorized use.

3.3 Content Standards: All contributions must adhere to our Community Editorial & Moderation Guidelines. Prohibited content includes, but is not limited to:

• Defamatory, harassing, or abusive material

• Content that promotes hatred or discrimination based on race, religion, caste, gender, sexual orientation, or disability

• Infringing material (copyright, trademark, or other intellectual property rights)

• False or misleading information presented as fact

• Content that violates the privacy of others (doxxing, sharing private contact information)

• Sexually explicit or pornographic material

• Content promoting illegal activities

3.4 Prohibited Conduct: You may not:

• Vandalize or deliberately introduce false information

• Engage in edit wars or disruptive editing

• Harass other contributors

• Use automated tools (bots) to make edits without explicit permission

• Attempt to circumvent moderation or security measures

4. License to Your Contributions #

4.1 To ensure that GyanVapy Wiki™ can remain free and accessible, you agree to license your contributions under the terms of the Creative Commons Attribution-ShareAlike 4.0 International License (“CC BY-SA 4.0”).

4.2 What This Means: Anyone, including MyMahotsav and the general public, can use, share, and adapt your contributions, provided they:

• Give you appropriate credit (attribution)

• Indicate if changes were made

• License their new creations under the same terms (ShareAlike)

4.3 This is the standard license used by collaborative projects and ensures the knowledge remains freely available for everyone.

4.4 Representation and Warranty: By contributing, you represent and warrant that:

• You own the content you are posting or have the necessary rights to license it under CC BY-SA 4.0

• Your contribution does not infringe any third-party rights

• Your contribution complies with these Terms and all applicable laws

4.5 Moral Rights: To the extent permitted by law, you waive any moral rights that would otherwise limit the full exercise of the license granted herein.

5. Moderation and Enforcement #

5.1 Community Moderators: GyanVapy Wiki™ may have volunteer community moderators who help enforce these Terms and the Editorial Guidelines. Moderators are independent volunteers and not employees or agents of MyMahotsav.

5.2 Platform Rights: We reserve the right, but do not assume the obligation, to:

• Remove or refuse any content that violates these Terms

• Restrict, suspend, or terminate the accounts of users who violate these Terms

• Take any other action we deem appropriate to protect the integrity of the platform and its community

5.3 Reporting Violations: If you find content that violates these Terms, please report it using the designated “Report” tools or by emailing wiki-abuse@gyanvapy.com.

5.4 Repeat Infringers: Users who repeatedly violate these Terms or infringe intellectual property rights may have their accounts permanently terminated.

6. Disclaimer of Warranties #

6.1 Content “As Is”: ALL CONTENT ON GYANVAPY WIKI™ IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY INFORMATION.

6.2 No Warranty of Religious Orthodoxy: We do not warrant that any content reflects the official position or orthodoxy of any religious tradition. Religious and cultural information is inherently subject to interpretation and diverse viewpoints.

6.3 Third-Party Links: The wiki may contain links to third-party websites. We are not responsible for the content or accuracy of those sites.

7. Limitation of Liability #

7.1 No Liability for User Content: TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYMAHOTSAV FUTURETECH LTD AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR RELIANCE ON ANY CONTENT POSTED BY USERS.

7.2 Total Liability: IN ANY EVENT, OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF:

• The amount you paid us (if any) in the 12 months preceding the claim, or

• £100 (or equivalent in local currency)

7.3 Exceptions: Nothing in these Terms excludes or limits liability for:

• Death or personal injury caused by negligence

• Fraud or fraudulent misrepresentation

• Any liability that cannot be limited or excluded by applicable law

8. Indemnification #

8.1 You agree to indemnify, defend, and hold harmless MyMahotsav Futuretech Ltd, its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

• Your contributions to GyanVapy Wiki™

• Your violation of these Terms

• Your violation of any third-party rights, including intellectual property or privacy rights

9. Termination #

9.1 We may terminate or restrict your access to GyanVapy Wiki™ at any time, with or without cause, with or without notice.

9.2 Upon termination, the licenses granted by you for your contributions shall survive, as the content may remain on the platform.

10. Governing Law and Dispute Resolution #

10.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of laws principles.

10.2 Informal Resolution: Before filing any claim, you agree to attempt to resolve the dispute informally by contacting us at disputes@gyanvapy.com. We will attempt to resolve the dispute within 45 days.

10.3 Arbitration: If the dispute is not resolved informally, it shall be resolved exclusively by binding arbitration in accordance with the rules of the London Court of International Arbitration (LCIA). The arbitration shall take place in London, United Kingdom, and shall be conducted in English.

10.4 Class Action Waiver: YOU AND GYANVAPY WIKI™ AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

11. Changes to These Terms #

11.1 We may modify these Terms from time to time. If we make material changes, we will notify you by email or through a notice on our platform.

11.2 Your continued use of GyanVapy Wiki™ after the effective date of changes constitutes acceptance of the modified Terms.

12. Contact Information #

Part C: Jurisdiction-Specific Addendums #

India Addendum #

IT Act, 2000 & IT Rules, 2021:

• GyanVapy Wiki™ is an intermediary under Section 2(w) of the IT Act and is entitled to safe harbor protection under Section 79, subject to compliance with due diligence requirements.

• Our Grievance Officer shall acknowledge complaints within 24 hours and resolve them within 15 days.

• We will publish monthly compliance reports as required for significant social media intermediaries (if applicable).

Religious Sensitivity: Content that deliberately insults religious beliefs may violate Section 295A of the Indian Penal Code. Such content will be removed upon notification.

UK/EU Addendum #

Digital Services Act / Online Safety Act:

• We will comply with our duties to protect users from illegal content.

• Users have the right to appeal content moderation decisions.

• We will publish transparency reports as required.

GDPR: Users have rights to access, rectification, and erasure of their personal data. See our Privacy Policy for details.

US Addendum #

Section 230: GyanVapy Wiki™ is a provider of interactive computer services and shall not be treated as the publisher or speaker of any information provided by another information content provider.
