How Intellectual Property Works on GyanVapy Courses™ #
This document explains the intellectual property rights of instructors, students, and the platform. It’s about who owns what and what licenses are granted.
The Simple Truth #

Instructors Own Their Content: You keep full ownership of your courses. You’re just giving us permission to host and distribute them.

Students Get Limited Licenses: Students can access courses for personal learning but can’t redistribute or sell the content.

Platform Owns the Platform: We own the GyanVapy Courses™ website, software, and brand.

No Transfer of Ownership: Nothing in these agreements transfers ownership of intellectual property—only licenses are granted.
Part B: Intellectual Property Rights #
1. Instructor Intellectual Property #
1.1 Ownership: Instructors retain all right, title, and interest in and to their course content, including:

Video lectures
-
Presentations and slides
-
Text materials
-
Quizzes and assessments
-
Images and graphics
-
Any other original content created for the course
1.2 No Transfer: Nothing in these Terms transfers ownership of instructor content to GyanVapy Courses™ or to students.
2. License from Instructor to GyanVapy Courses™ #
2.1 License Grant: By publishing a course on the platform, instructors grant GyanVapy Courses™ a non-exclusive, worldwide, royalty-free, transferable, sub-licensable license to:

Host, store, reproduce, and maintain the course content

Stream, display, perform, and distribute the content to enrolled students

Use the content for platform promotional purposes (with attribution)

Modify the content only as necessary for technical compatibility

Sub-license these rights to service providers and affiliates
2.2 License Duration: This license continues for as long as the course is published on the platform. Upon course removal, the license terminates, but students who enrolled while the course was published retain their access rights.
2.3 Promotional Use: We may use excerpts of your course (trailers, previews) to promote the platform. You may opt out of certain promotional uses by contacting us.
3. License from GyanVapy Courses™ to Students #
3.1 Student License: Upon enrollment, students receive a non-exclusive, non-transferable, revocable license to access and view the course content for personal, non-commercial educational purposes only.
3.2 License Limitations: Students may not:

Download and redistribute course content (except where offline viewing is explicitly enabled)

Sell course materials or access

Create derivative works based on course content

Use content for commercial purposes

Share login credentials
4. Platform Intellectual Property #
4.1 Platform Ownership: GyanVapy Courses™ and MyMahotsav Futuretech Ltd own all right, title, and interest in:

The GyanVapy Courses™ website and mobile applications

Platform software and technology
-
GyanVapy trademarks, logos, and branding
-
Aggregated, anonymized data
-
Platform-generated analytics and reports
4.2 No License: Except as expressly provided, no license to platform intellectual property is granted to instructors or students.
5. Third-Party Content #
5.1 Instructor Responsibility: Instructors are responsible for ensuring they have all necessary rights for any third-party content included in their courses (images, music, video clips, etc.).
5.2 Student Responsibility: Students are responsible for their use of third-party tools or resources referenced in courses.
6. Copyright Infringement Claims #
6.1 DMCA Compliance: GyanVapy Courses™ complies with the Digital Millennium Copyright Act and similar laws in other jurisdictions.
6.2 Reporting: Copyright infringement claims should be sent to copyright@gyanvapy.com with the required information.
6.3 Repeat Infringers: Accounts of repeat infringers will be terminated.
7. Moral Rights #
7.1 Acknowledgment: Instructors retain moral rights in their content to the extent provided by applicable law.
7.2 Waiver: To the extent permitted by law and necessary for the licenses granted herein, instructors agree not to assert moral rights that would limit the full exercise of the licenses.
