Who Owns What in Utsav Contests™ #
This document explains the intellectual property rights for contest entries. We’ve designed these terms to be fair—you keep your ownership, and we get the rights we need to run the contest and promote your work .
The Simple Truth #

You Keep Your Copyright: Your photos, videos, recipes, and essays remain yours. Always .

We Get a License: You give us permission to use your entry for the contest, promote it, and feature winners .

No Sneaky Rights: We don’t claim ownership, and we won’t sell your work to others without asking.

Winners Grant More: If you win, we may need perpetual rights to keep featuring you as a winner.

Credit Always Given: We’ll credit you whenever we use your work .
Part B: Legal Terms and Conditions #
1. OWNERSHIP #
1.1 Entrant Retains Ownership: Entrant retains all right, title, and interest in and to the entry, including all copyright and other intellectual property rights .
1.2 No Transfer: These Licensing Terms do not transfer ownership of any intellectual property rights from Entrant to MyMahotsav.
2. License Grant FROM ENTRANT #
2.1 Contest Participation License: By submitting an entry, Entrant grants to MyMahotsav and its designees (including Contest Sponsors) a non-exclusive, worldwide, royalty-free, sub-licensable license to:

Host, store, reproduce, and maintain the entry on Utsav Contests™ platforms

Display, perform, and distribute the entry in connection with the Contest

Use the entry for promotional purposes related to the Contest, including on websites, social media, newsletters, and marketing materials
-
Create derivative works solely for the purpose of promoting the Contest (e.g., thumbnails, compilations, highlight reels)
-
Allow third parties, including media partners and press, to reproduce the entry in connection with news coverage of the Contest, provided the Entrant is credited
2.2 License Duration – Non-Winning Entries:

The license granted in Section 2.1 shall continue for a period of [three (3) years] from the conclusion of the Contest.

After this period, MyMahotsav shall cease using the entry except where it has been incorporated into materials distributed before the license expiration (e.g., printed publications, archived promotional materials).
2.3 License Duration – Winning Entries:

If Entrant is selected as a winner, the license granted in Section 2.1 becomes perpetual and irrevocable for purposes of promoting the winner’s status and the Contest itself.

This perpetual license is limited to uses directly related to the winner’s achievement and promotion of the Contest .
2.4 Important Limitations on License:

The license is non-exclusive, meaning Entrant may license the same work to others, including commercially .

MyMahotsav may not sell or commercially license the entry to third parties for independent use without Entrant’s separate written consent.

MyMahotsav may not use the entry in ways that are false or misleading about Entrant’s endorsement of any product or service.
3. MORAL RIGHTS #
3.1 Entrant retains all moral rights in the entry to the extent provided by applicable law .
3.2 MyMahotsav agrees to provide attribution to Entrant in connection with any public use of the entry, including by displaying Entrant’s name or username .
3.3 MyMahotsav shall not intentionally alter or modify the entry in a way that would be prejudicial to Entrant’s reputation.
4. REPRESENTATIONS AND WARRANTIES #
4.1 Entrant represents and warrants that:

Entrant owns all rights to the entry or has obtained all necessary licenses and permissions

The entry does not infringe any third-party intellectual property rights

Entrant has obtained all necessary model releases, property releases, and other permissions
-
The entry does not violate any applicable laws or regulations
5. THIRD-PARTY CONTENT #
5.1 If the entry contains third-party content (e.g., music in videos, images in collages), Entrant must:

Obtain all necessary licenses and permissions
-
Provide documentation upon request
-
Ensure the third-party content does not restrict the licenses granted in Section 2
5.2 Entries containing unauthorized third-party content may be disqualified.
6. PUBLIC DOMAIN AND OPEN LICENSES #
6.1 If Entrant chooses to license the entry under Creative Commons or other open licenses, Entrant must clearly indicate this in the submission.
6.2 MyMahotsav’s use under Section 2 shall comply with any open license terms designated by Entrant.
7. INFRINGEMENT CLAIMS #
7.1 Reporting: To report copyright infringement in any entry, contact copyright@utsavcontests.com with the information required under applicable law (DMCA, etc.).
7.2 Response: MyMahotsav will respond to valid infringement claims by removing the challenged content and notifying the Entrant.
7.3 Repeat Infringers: Entrants who are repeat infringers may have their accounts terminated.
8. Indemnification #
8.1 Entrant agrees to indemnify and hold MyMahotsav harmless from any claims arising out of or related to the entry, including claims of intellectual property infringement
