This document contains important limitations on our legal responsibility. It’s standard for contest platforms and helps protect us while ensuring we can continue to offer these opportunities.

The Simple Truth #

• We’re Not Responsible for Everything: Like technical glitches, lost entries, or things outside our control .

• You Use the Platform at Your Own Risk: We provide the platform “as is” without guarantees.

• Our Liability Is Limited: If something goes wrong, our liability is capped.

• This Is Standard: Similar protections appear in every major contest platform’s terms .

Part B: Legal Terms and Conditions #

1. DISCLAIMER OF WARRANTIES #

1.1 THE UTSAV CONTESTS™ PLATFORM AND ALL CONTENT, SERVICES, AND FUNCTIONALITY ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

1.2 TO THE FULLEST EXTENT PERMITTED BY LAW, MYMAHOTSAV DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement

• Warranties that the platform will be uninterrupted, error-free, secure, or virus-free

• Warranties regarding the accuracy, reliability, or completeness of any contest information

• Warranties regarding the conduct of any entrant or judge

2. LIMITATION OF LIABILITY #

2.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MYMAHOTSAV, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages

• Any loss of profits, revenue, data, or goodwill

• Any damages arising from technical failures, lost entries, or unauthorized access

• Any claims based on entrant conduct or content

• Any disputes between entrants or between entrants and sponsors

2.2 IN ANY EVENT, MYMAHOTSAV’S TOTAL LIABILITY TO ANY ENTRANT SHALL NOT EXCEED THE GREATER OF:

• The amount paid by the entrant (if any) in connection with the Contest, or

• £100 (or equivalent in local currency)

3. SPECIFIC DISCLAIMERS #

3.1 Technical Issues: MyMahotsav is not responsible for:

• Lost, late, incomplete, damaged, corrupted, or misdirected entries

• Technical failures of any kind, including telephone, computer, network, or electronic failures

• Inaccessibility of the Contest website

• Unauthorized human intervention in the Contest

• Errors in the administration of the Contest or the announcement of prizes

3.2 Entry Content: MyMahotsav is not responsible for the content of any entry, including any defamatory, offensive, or illegal material.

3.3 Judging: MyMahotsav is not responsible for the subjective opinions of judges.

3.4 Sponsors: MyMahotsav is not responsible for the acts or omissions of Contest Sponsors.

4. RELEASE #

4.1 By entering a Contest, Entrant releases and holds harmless MyMahotsav, Sponsors, and their respective affiliates, officers, directors, employees, and agents from any and all liability for any injuries, loss, or damage of any kind arising from or in connection with:

• Participation in the Contest

• Acceptance, use, or misuse of any prize

• Any travel or activity related to prize acceptance

5. Indemnification #

5.1 Entrant agrees to indemnify, defend, and hold harmless MyMahotsav and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

• The entry submitted by Entrant

• Entrant’s violation of these Official Rules

• Entrant’s violation of any third-party rights

6. Force Majeure #

6.1 MyMahotsav shall not be liable for any failure or delay in performing its obligations where such failure or delay results from any cause beyond its reasonable control, including but not limited to: acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, pandemics, epidemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials .

6.2 If a Contest is cancelled or postponed due to Force Majeure, MyMahotsav reserves the right to:

• Select winners from eligible entries received before the event

• Reschedule the Contest

• Award prizes as reasonably determined
