• Predictions Are Not Guarantees: Astrology is a guidance tool, not a science with guaranteed outcomes. Your future is in your hands .

• Not Medical/Financial/Legal Advice: Astrological insights are not substitutes for professional advice in these critical areas. We’ll remind you of this often .

• Your Information Is Protected: Birth details are sensitive—we treat them with care.

• Third-Party Providers: Many services come from independent astrologers or API partners. We facilitate but don’t control them.

Part B: Legal Terms and Conditions #

1. INTRODUCTION AND ACCEPTANCE #

1.1 These Utsav Jyotish™ Terms of Service (“Terms”) constitute an electronic record in accordance with the Information Technology Act, 2000 and the Information Technology (Intermediaries Guidelines) Rules, 2011. They govern your (“You”, “Your”, “User”) use of the Utsav Jyotish™ website, mobile applications, services, features, and content (“Platform”) operated by MyMahotsav Futuretech Ltd (“MyMahotsav”, “We”, “Us”, “Our”) .

1.2 By accessing or using the Platform, including clicking “I AGREE” or registering for an account, you acknowledge that you have read, understood, and agree to be bound by these Terms and all policies incorporated herein .

1.3 If you disagree with any part of these Terms, you must immediately cease using the Platform .

3. ELIGIBILITY AND ACCOUNT REGISTRATION #

3.1 Age Requirement: You must be at least 18 years of age to register for an account or use any paid services. By using the Platform, you represent and warrant that you are at least 18 years old .

3.2 Registration: To access certain features, you must register for an account using accurate, current, and complete information. You agree to update your information as necessary to maintain its accuracy .

3.3 Account Security: You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at support@utsavjyotish.com of any unauthorized use .

3.4 One Account Per User: You may not create multiple accounts or use automated means to create accounts .

3.5 Account Suspension: We reserve the right to suspend or terminate accounts for untrue, inaccurate, or incomplete registration information, or for breach of any term .

4. DESCRIPTION OF SERVICES #

4.1 Platform Services: Utsav Jyotish™ provides a technology platform that enables Users to access:

• Automated astrological calculations and reports

• Live consultations with independent Astrologers

• Purchase of Remedial Products from third-party sellers

4.2 No Professional Relationship: Except as expressly stated, MyMahotsav is not a provider of astrological services and does not employ, endorse, or recommend any Astrologer or seller. All services are provided by independent third parties .

4.3 Entertainment Purpose: ALL SERVICES PROVIDED THROUGH THE PLATFORM ARE FOR INFORMATIONAL, SPIRITUAL, AND ENTERTAINMENT PURPOSES ONLY. They are not a substitute for professional advice .

4.4 Modification of Services: We reserve the right to modify, suspend, or discontinue any part of the Platform at any time without notice or liability .

5. AUTOMATED ASTROLOGY SERVICES #

5.1 Nature of Automated Services: Automated reports and predictions are generated using software, algorithms, and third-party APIs. They are based on astrological principles but are not personalized by human astrologers.

5.2 API Integration: Some automated services rely on third-party API providers. We do not control these providers and disclaim all liability for their accuracy or availability.

5.3 No Guarantee of Accuracy: WE DO NOT WARRANT THAT ANY AUTOMATED REPORT, PREDICTION, OR CALCULATION IS ACCURATE, COMPLETE, OR RELIABLE. You acknowledge that astrological interpretations are subjective and may vary .

6. ASTROLOGER CONSULTATIONS #

6.1 Independent Contractors: All Astrologers offering consultations through the Platform are independent contractors, not employees, partners, or agents of MyMahotsav .

6.2 User-Astrologer Relationship: Any consultation, advice, or interaction between you and an Astrologer is strictly between you and the Astrologer. MyMahotsav is not a party to this relationship.

6.3 No Endorsement: We do not endorse, recommend, or verify the qualifications, expertise, or accuracy of any Astrologer. You are responsible for exercising your own judgment .

6.4 No Liability: MyMahotsav is not liable for any advice, statements, representations, or outcomes arising from consultations with Astrologers.

7. REMEDIAL PRODUCTS #

7.1 Third-Party Sellers: All Remedial Products are sold by independent third-party sellers, not by MyMahotsav. We are not a party to any transaction between you and a seller.

7.2 Product Claims: Sellers are solely responsible for all representations about their products, including claims of authenticity, quality, efficacy, or astrological significance.

7.3 No Endorsement: We do not endorse or guarantee any product, nor do we warrant that any product will have the claimed astrological effect.

8. USER REPRESENTATIONS AND WARRANTIES #

8.1 By using the Platform, you represent and warrant that :

• You are legally competent to enter into these Terms

• All information you provide is accurate and true

• Your use is lawful and does not violate any applicable law or third-party rights

• You will not use the Platform for unauthorized, commercial, or prohibited purposes

• You will not extract Platform content for data scraping, ML/AI model training, or any unauthorized purpose

9. PROHIBITED CONDUCT #

9.1 You agree not to :

• Violate any law, regulation, or third-party rights

• Post, transmit, or share unlawful, defamatory, harassing, obscene, or infringing content

• Conduct unauthorized commercial activity or advertisements

• Attempt unauthorized access, introduce viruses or malicious code, or interfere with Platform operations

• Extract Platform content for data scraping, ML/AI model training, or any unauthorized purpose

• Impersonate any person or entity

• Harass or stalk any Astrologer or other User

10. INTELLECTUAL PROPERTY RIGHTS #

10.1 Platform Content: All content, software, databases, graphics, text, designs, and trademarks on the Platform are proprietary to MyMahotsav or its licensors .

10.2 Limited License: Users are granted a limited, non-exclusive, non-transferable right to access Services strictly for personal, non-commercial use in accordance with these Terms .

10.3 User Content: By submitting content (including reviews, feedback, or consultation records), you grant MyMahotsav a worldwide, royalty-free license to use, reproduce, and display such content for platform operations.

10.4 Prohibited Uses: You may not reproduce, reverse-engineer, republish, transmit, or otherwise exploit Platform content for any commercial, derivative, or AI/data training purposes .

11. PAYMENT AND FEES #

11.1 Service Fees: Paid Services require timely payment of applicable charges, including all taxes where required .

11.2 Payment Processing: Payments are processed via authorized payment gateways. You represent and warrant that you are authorized to use any payment method you submit .

11.3 No Refunds: Except as provided in the Astrology Pricing & Refund Policy (JY-16), all payments are non-refundable .

11.4 Third-Party Issues: MyMahotsav is not responsible for any payment-related issues arising from third-party providers .

12. DISCLAIMER OF WARRANTIES #

12.1 AS IS: THE PLATFORM AND ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED .

12.2 Specific Disclaimers: TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING :

• Implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement

• Warranties that the Platform will be uninterrupted, error-free, secure, or virus-free

• Warranties regarding the accuracy, reliability, or completeness of any predictions, reports, or advice

• Warranties regarding the qualifications or expertise of any Astrologer

• Warranties regarding the authenticity or efficacy of any Remedial Product

12.3 No Guarantee of Outcomes: We do not guarantee that any prediction, guidance, or recommendation will materialize or produce any specific result .

12.4 Entertainment Purpose: You acknowledge that all astrological services are for entertainment purposes only and should not be relied upon for making critical life decisions .

13. LIMITATION OF LIABILITY #

13.1 General Limitation: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MYMAHOTSAV, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR :

• Any indirect, incidental, special, consequential, or punitive damages

• Any loss of profits, revenue, data, or goodwill

• Any damages arising from use of or reliance on any prediction, report, or advice

• Any disputes between Users and Astrologers or between Users and sellers

13.2 Cap on Liability: IN ANY EVENT, MYMAHOTSAV’S TOTAL LIABILITY TO ANY USER SHALL NOT EXCEED THE GREATER OF :

• The amount paid by the User through the Platform in the twelve (12) months preceding the claim, or

• £100 (or equivalent in local currency)

13.3 User Actions: You acknowledge that your access and use are at your own risk and discretion .

14. Indemnification #

14.1 You agree to indemnify, defend, and hold harmless MyMahotsav, its partners, employees, and affiliates against all damages, losses, and expenses arising from :

• Your breach of these Terms or any incorporated policies

• Your violation of applicable laws or third-party rights

• Your misuse or unauthorized use of Services

• Any claims arising from your interactions with Astrologers or sellers

15. THIRD-PARTY LINKS AND INTEGRATIONS #

15.1 The Platform may contain links to third-party websites or services, including API providers. We are not responsible for such external content or services .

15.2 We strongly advise you to read the terms and conditions and privacy policies of any third-party services that you access .

16. TERMINATION #

16.1 By Us: We may terminate or suspend your account, without notice or refund, for breach of these Terms, the Privacy Policy, or applicable laws .

16.2 By You: You may terminate your account via written request to support@utsavjyotish.com.

16.3 Survival: Provisions regarding intellectual property, limitation of liability, Indemnification, and dispute resolution shall survive termination.

17. DISPUTE RESOLUTION AND GOVERNING LAW #

17.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of laws principles.

17.2 Arbitration: Any dispute arising out of or relating to these Terms shall be resolved exclusively by binding arbitration in accordance with the rules of the London Court of International Arbitration (LCIA). The arbitration shall take place in London, United Kingdom, and shall be conducted in English .

17.3 Class Action Waiver: YOU AND MYMAHOTSAV AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING .

17.4 Jurisdiction for India: For disputes arising from Users in India, the courts in Gurugram, Haryana shall have exclusive jurisdiction, and arbitration shall take place in Gurugram under the Arbitration and Conciliation Act, 1996 .

18. MODIFICATION OF TERMS #

18.1 We reserve the right to amend, modify, or update these Terms at any time, at our sole discretion. Such changes become effective upon being published on the Platform or otherwise notified .

18.2 Your continued use of the Platform after any changes constitutes acceptance of the modified Terms. If you do not agree, you must terminate your account .

19. CONTACT INFORMATION #

Part C: Jurisdiction-Specific Addendums #

India Addendum #

Consumer Protection: Under the Consumer Protection Act, 2019, astrologers offering services for consideration may be deemed service providers. However, the abstract nature of predictions makes proving causation challenging .

IT Act Compliance: MyMahotsav is an intermediary under the Information Technology Act, 2000 and complies with all due diligence requirements under the IT Rules, 2021 .

ASCI Guidelines: Advertising Standards Council of India prohibits unsubstantiated supernatural claims. Our marketing complies with these guidelines.

UK/EU Addendum #

Premium Rate Services: If using premium rate numbers, we comply with Phone-paid Services Authority (PSA) Code of Practice, including clear pricing disclosures and fairness requirements .

GDPR: For EU/UK residents, personal data is processed in accordance with GDPR. You have rights to access, rectification, and erasure.

Consumer Rights: Nothing in these Terms limits your statutory rights under the Consumer Rights Act 2015.

US Addendum #

Disclaimer Variations: Some states do not allow limitations of liability for certain damages. The limitations in Section 13 apply to the fullest extent permitted by law in your state .

FTC Guidelines: Testimonials and endorsements must reflect honest opinions and typical results.
