This agreement is for vendors who wish to sell gemstones, rudraksha, yantras, and other remedial products through our platform.
The Simple Truth #

You’re an Independent Seller: You are not employed by MyMahotsav. You run your own business.

Authenticity Is Critical: Buyers trust that gemstones are genuine, rudraksha are authentic. You must be truthful.

No Medical Claims: You cannot claim products cure diseases or provide medical benefits.

You’re Responsible for Fulfillment: Shipping, returns, and customer service are your responsibility.

We Facilitate Sales: We provide the marketplace; you provide the products.
Part B: Legal Terms and Conditions #
1. SELLER STATUS #
1.1 Sellers are independent third-party vendors, not employees, partners, or agents of MyMahotsav.
1.2 Sellers are solely responsible for:

Product quality and authenticity

Accurate product descriptions
-
Order fulfillment and shipping
-
Customer service and returns
-
Compliance with all applicable laws
2. PRODUCT REQUIREMENTS #
2.1 All products must be accurately described, including:

Type (gemstone, rudraksha, yantra, etc.)

Specifications (carat weight, size, origin)
-
Authenticity claims (natural, certified, etc.)
-
Any known limitations or contraindications
2.2 Prohibited Product Claims:

No medical or therapeutic claims (e.g., “cures diabetes”)
-
No guaranteed outcomes (e.g., “will bring wealth within 30 days”)
-
No supernatural claims (e.g., “contains magical powers”)
2.3 Products must comply with all applicable laws and regulations in the jurisdictions where they are sold.
3. AUTHENTICITY REPRESENTATIONS #
3.1 Sellers represent and warrant that all products are authentic as described.
3.2 For gemstones: Sellers must accurately represent whether stones are natural, treated, synthetic, or imitation.
3.3 For rudraksha: Sellers must accurately represent mukhi (faces), origin, and authenticity.
3.4 Upon request, sellers must provide certification or documentation supporting authenticity claims.
4. SELLER OBLIGATIONS #
4.1 Fulfillment: Sellers must ship orders promptly (within [X] business days) and provide tracking information.
4.2 Customer Service: Sellers must respond to customer inquiries within [48 hours].
4.3 Returns: Sellers must comply with our Shipping, Returns & Refund Policy (JY-15).
4.4 Taxes: Sellers are responsible for collecting and remitting all applicable taxes.
5. FEES AND PAYMENTS #
5.1 Commission: MyMahotsav retains a commission of [X]% on each sale.
5.2 Payouts: Seller proceeds are paid on a [weekly/monthly] basis, minus commission and any refunds.
5.3 Refunds: If a refund is issued, the seller’s account will be debited for the product amount.
6. PROHIBITED PRODUCTS #
6.1 The following products may NOT be sold:

7. TERMINATION #
7.1 We may suspend or terminate seller accounts for:

Breach of these Terms

Receipt of multiple customer complaints

Fraudulent activity
