Part B: Copyright Infringement Procedures #
1. DMCA COMPLIANCE (UNITED STATES) #
1.1 Utsav Voices™ complies with the Digital Millennium Copyright Act (17 U.S.C. §512). We have designated an agent to receive notices of claimed infringement.

2. FILING A COPYRIGHT INFRINGEMENT NOTICE #
2.1 To file a copyright infringement notice, you must provide :

Your physical or electronic signature

Identification of the copyrighted work claimed to have been infringed

Identification of the material that is claimed to be infringing, with enough detail that we can locate it (URL of the article)

Your contact information (address, phone number, email)

A statement that you have a good faith belief that the use is not authorized

A statement, under penalty of perjury, that the information is accurate and you are authorized to act

3. RESPONSE TO NOTICES #
3.1 Upon receiving a valid notice, we will:

Remove or disable access to the allegedly infringing material

Notify the user who posted the material

Provide information about the notice and removal
4. COUNTER-NOTICE PROCEDURE #
4.1 If you believe your content was removed by mistake, you may file a counter-notice containing :

Your physical or electronic signature

Identification of the removed material and where it appeared

A statement under penalty of perjury that you have a good faith belief the material was removed by mistake

Your name, address, and phone number

Consent to jurisdiction of federal court in your district
4.2 Counter-notices should be sent to: copyright@utsavvoices.com
4.3 Upon receiving a valid counter-notice, we may restore the material in 10-14 business days unless the original filer seeks a court order.
5. INTERNATIONAL COPYRIGHT CLAIMS #
5.1 For users outside the United States, we will respond to valid copyright notices under applicable international laws. Please provide similar information as required for DMCA notices.
6. REPEAT INFRINGER POLICY #
6.1 Termination for Repeat Infringement: We will terminate, in appropriate circumstances, the accounts of users who are repeat infringers of intellectual property rights .
6.2 What Constitutes a Repeat Infringer:

Users who have been subject to at least two valid copyright complaints

Users who demonstrate a pattern of infringing activity
6.3 Discretion: We reserve the right to terminate accounts for a single egregious violation at our discretion.

8. MISREPRESENTATION #
8.1 Knowingly misrepresenting that material is infringing may subject you to liability for damages, including costs and attorneys’ fees .
9. ACCOUNT SUSPENSION PENDING RESOLUTION #
9.1 In cases of clear, egregious infringement, we may suspend accounts pending investigation and resolution.

India Addendum #
Copyright Act, 1957: Section 52 provides certain fair use exceptions. Our takedown procedures comply with Indian copyright law and IT Act intermediary guidelines.
UK/EU Addendum #
Copyright, Designs and Patents Act 1988: We respect the rights of copyright holders and respond to valid notices under UK/EU law.
