Part A: Plain English Summary #
Your Agreement as a Utsav Venues™ Host #
Welcome to Utsav Venues™! This document explains the terms that apply when you list your space on our platform. As a host, you’re an independent business owner—we provide the technology to help you reach renters.
The Simple Truth #

You’re in Control: You set your prices, availability, cancellation policy, and house rules. You decide whether to approve bookings instantly or review them first.

You’re Responsible for Your Venue: You know your space best. You’re responsible for its safety, legal compliance, and accuracy of your Listing .

Insurance is Mandatory: To protect you, your renters, and us, you must carry appropriate public liability insurance (minimum £10 million recommended) .

You Keep Your Earnings: After our platform commission, you receive the rental income. We handle payment collection and transfer your earnings after the event.

Be Accurate and Honest: Your Listing must accurately describe your venue. Misleading descriptions can lead to disputes and account suspension.
Part B: Legal Terms and Conditions #
1. HOST STATUS AND RELATIONSHIP #
1.1 Independent Contractor: Hosts are independent contractors, not employees, partners, or agents of MyMahotsav. Nothing in this Agreement creates an employment, partnership, or agency relationship .
1.2 Sole Responsibility: Hosts are solely responsible for:

Their Venue, including its safety, condition, and compliance with laws

All obligations to Renters arising from Bookings

Their own taxes, including income tax and GST/VAT
-
Their own business expenses and insurance
2. ELIGIBILITY AND APPLICATION #
2.1 To become a Host, you must:

Be at least 18 years of age

Have the legal authority to list and rent the Venue (as owner or authorized agent)

Provide accurate and complete registration information
-
Consent to verification procedures (identity verification, address verification)
-
Maintain required insurance coverage
2.2 We reserve the right to accept or reject any Host application at our sole discretion.
3. Listing REQUIREMENTS #
3.1 Listing Accuracy: Hosts must provide accurate, complete, and current information about their Venue, including :

| House Rules | Clear rules regarding noise, alcohol, smoking, decorations, etc. |
3.2 Prohibited Listings: Hosts may not list:

Spaces they do not have legal authority to rent

Spaces that do not comply with applicable safety regulations

Spaces used for illegal activities

Residential properties where short-term rentals are prohibited
3.3 Updates: Hosts must promptly update their listings when information changes, including pricing, availability, and amenities.
4. HOST OBLIGATIONS AND WARRANTIES #
4.1 Legal Compliance: Hosts represent and warrant that :

They have obtained all necessary licenses, permits, and authorizations required for their Venue (including alcohol licenses, food service permits, public entertainment licenses)

The Venue complies with all applicable safety regulations, including fire safety, electrical safety, and occupancy limits

The Venue complies with accessibility requirements where applicable
-
They will comply with all noise regulations, curfews, and other local restrictions
-
They will not discriminate against Renters on prohibited grounds
4.2 Safety Responsibilities: Hosts agree to :

Maintain the Venue in a safe condition

Conduct regular safety inspections
-
Provide adequate fire extinguishers, first aid equipment, and emergency exits

Inform Renters of emergency procedures
-
Ensure all electrical equipment is properly maintained
4.3 Insurance Requirements: Hosts must maintain :

4.4 Proof of Insurance: Hosts must provide valid Certificates of Insurance upon request. Failure to maintain required insurance may result in suspension .
5. BOOKING MODELS AND HOST RESPONSES #
5.1 Booking Models: Hosts may choose between:

| Request-Based | Renters submit booking requests; Host must approve or decline within [24 hours] |
5.2 Response Requirements: For request-based bookings, Hosts must respond to all booking requests within [24 hours]. Failure to respond may result in automatic decline and potential impact on host standing.
5.3 Booking Confirmation: Once confirmed, a binding agreement exists between Host and Renter. Hosts must honor confirmed Bookings .
6. CANCELLATION POLICIES #
6.1 Policy Selection: Hosts must select a cancellation policy from the options provided in the Deposit, Cancellation & Damage Policy (VV-4). The selected policy will be clearly displayed on the Listing.
6.2 Host-Initiated Cancellation: If a Host cancels a confirmed Booking (except in cases of Force Majeure) :

The Renter will receive a full refund

The Host may be charged a cancellation fee

The Host’s Listing may be penalized (reduced visibility)
-
Repeat cancellations may result in account suspension
6.3 Force Majeure: If a Booking must be cancelled due to circumstances beyond the Host’s reasonable control (natural disasters, government orders, etc.), the Host must notify the Renter immediately and provide documentation. Refunds will be handled as described in the Deposit Policy .
7. PAYMENTS AND FEES #
7.1 Pricing: Hosts set their own rental rates. All prices must be clearly disclosed, including any additional fees (cleaning, security, overtime) .
7.2 Platform Fee: MyMahotsav charges a commission of [X]% on each successful Booking. The fee is deducted from the total Booking amount before host payout.
7.3 Payouts: Hosts receive payment for confirmed Bookings within [3-5] business days after the event date, subject to:

No unresolved disputes or damage claims

Completion of the event

Verification of bank account details
7.4 Deposits: Any security deposits collected are held as described in the Deposit Policy (VV-4).
8. DAMAGE AND LIABILITY #
8.1 Damage Responsibility: Hosts may seek compensation for damage to their Venue caused by Renters or their guests through the process described in the Damage Policy (VV-4) .
8.2 Host Liability: Hosts remain liable for their own negligence and for claims arising from the condition of their Venue, regardless of any insurance they carry .
9. RENTER RELATIONSHIP #
9.1 Communication: Hosts agree to respond promptly to Renter inquiries and to provide clear instructions for access, parking, and event conduct.
9.2 Renter Compliance: Hosts may enforce their house rules and may terminate an event if Renters violate rules, subject to applicable law.
9.3 Reviews: Hosts may leave reviews of Renters. Reviews must be honest and not retaliatory.
10. TERMINATION #
10.1 By Host: Hosts may remove their listings at any time, subject to honoring existing Bookings.
10.2 By MyMahotsav: We may suspend or terminate Host accounts for:

Breach of these Terms

Multiple or serious Renter complaints

Failure to maintain required insurance

Fraudulent or deceptive conduct

Illegal activities
-
Any reason with 30 days’ notice
Part C: Jurisdiction-Specific Addendums #
India Addendum #
GST: Hosts earning above threshold must register for GST and comply with tax laws.
Local Permits: Many Indian cities require specific permits for events. Hosts are responsible for obtaining all necessary permissions.
UK/EU Addendum #
Licensing: Events with alcohol, regulated entertainment, or late-night refreshment may require premises licenses or Temporary Event Notices. Hosts must ensure compliance
