Your Agreement When Booking a Venue #

This document explains the terms that apply when you book a venue through Utsav Venues™. Please read it carefully—it affects your rights and responsibilities.

The Simple Truth #

  • Your Contract is With the Host: When you book, you’re entering into a rental agreement directly with the venue host. We facilitate the transaction but aren’t a party to your rental contract .

  • Read the Listing Carefully: Hosts provide detailed information about their venues. Make sure you understand the space, rules, and cancellation policy before booking.

  • Cancellation Terms Vary: Each host selects their own cancellation policy. Check it before you book—it affects your refund rights .

  • You’re Responsible for Your Event: You’re responsible for your guests’ behavior, compliance with house rules, and any damage caused.

  • Insurance Recommended: While hosts carry liability insurance, you may want your own event insurance for cancellations or other contingencies .


1. RENTER STATUS AND RELATIONSHIP #

1.1 Independent Relationship: When you book a Venue through the Platform, you enter into a direct contractual relationship with the Host. MyMahotsav is not a party to this agreement .

1.2 No Agency: MyMahotsav does not act as an agent for any Host. We provide the technology platform that facilitates your transaction.

2. ELIGIBILITY #

2.1 Age Requirement: You must be at least 18 years old to book a Venue. By making a Booking, you represent and warrant that you are at least 18 .

2.2 Authority: If you are booking on behalf of an organization or company, you represent that you have the authority to bind that entity.

3. BOOKING PROCESS #

3.1 Search and Selection: You may search for Venues based on location, dates, capacity, amenities, and other criteria. Listings provide information about the Venue, including descriptions, images, pricing, and house rules.

3.2 Booking Request:

  • For Instant Book listings: Your Booking is confirmed immediately upon payment.

  • For Request-Based listings: You submit a booking request; the Host has [24 hours] to approve or decline. If approved, your Booking is confirmed. If declined or if the Host doesn’t respond, any payment held will be refunded.

3.3 Booking Confirmation: Once confirmed, you will receive a confirmation email with details of your Booking. This confirmation constitutes your rental agreement with the Host .

4. PAYMENT #

4.1 Total Price: The total price displayed at checkout includes :

  • Venue rental fee

  • Applicable taxes (GST, VAT, sales tax)

  • Platform service fees

  • Any additional fees disclosed by the Host (cleaning, security, etc.)

4.2 Payment Methods: We accept various payment methods as displayed during checkout. Payment is processed through our secure third-party payment partners.

4.3 Authorization: By completing a Booking, you authorize us to charge the total amount to your selected payment method.

5. CANCELLATION AND REFUNDS #

5.1 Host Cancellation Policy: Each Listing displays the Host’s selected cancellation policy. Your refund rights depend on this policy and the timing of cancellation .

5.2 Standard Cancellation Tiers:

Flexible Full refund up to 14 days before event; 50% refund up to 7 days before; no refund thereafter
Moderate Full refund up to 30 days before; 50% refund up to 14 days before; no refund thereafter
Strict 50% refund up to 60 days before; no refund thereafter
No Refunds No refunds for any cancellation

5.3 Renter-Initiated Cancellation: To cancel a Booking, log into your account and follow the cancellation process. Refunds, if any, will be processed according to the applicable policy.

5.4 Host-Initiated Cancellation: If a Host cancels your Booking (except for Force Majeure), you will receive a full refund. You may also be eligible for additional assistance as described in our Rebooking Policy.

5.5 Force Majeure: If a Booking is cancelled due to Force Majeure events beyond anyone’s control, refunds will be handled as described in the Deposit Policy (VV-4) .

6. RENTER RESPONSIBILITIES #

6.1 Compliance with House Rules: You agree to comply with all house rules established by the Host, including :

  • Occupancy limits

  • Noise restrictions and curfews

  • Rules regarding alcohol, smoking, and decorations

  • Parking and loading instructions

  • Check-in and check-out procedures

6.2 Guest Conduct: You are responsible for the conduct of all guests attending your event. You agree to ensure that your guests comply with house rules and applicable laws.

6.3 Damage Responsibility: You are responsible for any damage to the Venue caused by you or your guests during your event, beyond normal wear and tear .

6.4 Legal Compliance: You agree to comply with all applicable laws, including:

  • Alcohol licensing laws (if serving alcohol)

  • Noise regulations

  • Age restrictions (if applicable)

  • Fire safety requirements

7. DAMAGE CLAIMS PROCESS #

7.1 Damage Assessment: If the Host believes damage has occurred, they must notify you and the Platform within [3] days of the event, providing evidence (photos, receipts).

7.2 Resolution: You and the Host may attempt to resolve the matter directly. If unresolved, claims may be submitted through our dispute resolution process or deducted from any security deposit held .

7.3 Liability: You remain liable for damage even if it exceeds any security deposit held.

8. INSURANCE #

8.1 Host Insurance: Hosts are required to carry public liability insurance. However, this insurance is primarily for the Host’s protection and may not cover your claims .

8.2 Your Insurance: We strongly recommend that you consider purchasing event insurance to cover :

  • Event cancellation for reasons beyond your control

  • Personal injury to you or your guests

  • Damage to your property or equipment

  • Liability for third-party claims

9. REVIEWS #

9.1 Honest Reviews: You may leave reviews of Venues you have booked. Reviews must be honest, based on actual experience, and not retaliatory.

9.2 Review Guidelines: Reviews may not contain:

  • Profanity or abusive language

  • Personal attacks

  • False or misleading statements

  • Confidential information

10. DISPUTE RESOLUTION #

10.1 Direct Resolution: In case of any dispute with a Host, you agree to first attempt to resolve the matter directly with the Host.

10.2 Platform Mediation: If direct resolution fails, you may request Platform mediation by contacting disputes@utsavvenues.com. We will facilitate communication but are not a decision-maker.

10.3 Legal Action: Disputes not resolved through mediation may be pursued through the legal process described in the Platform Terms of Service
