Part A: Plain English Summary #

Your Agreement as a Utsav Voices™ Writer #

This document explains the specific terms that apply when you contribute articles to Utsav Voices™. It’s your agreement with us about ownership, rights, and responsibilities.

The Simple Truth #

• You Keep Your Copyright: Your articles remain yours. Always. We just get permission to publish them .

• You’re Responsible for Your Words: You’re the author—you stand behind what you write.

• No Edits After Publication: To keep things transparent, once an article is published, it can’t be changed (though you can delete it entirely) .

• We Can Promote Your Work: You give us permission to feature your articles in promotions, newsletters, and social media.

• You Can Delete Anytime: Delete your article whenever you want, and it will be removed from public view.

Part B: Legal Terms and Conditions #

1. INTRODUCTION #

1.1 This Contributor Agreement (“Agreement”) supplements the Utsav Voices™ Terms of Service and applies specifically to individuals who submit Content for publication (“Contributors”).

1.2 By submitting any Content to Utsav Voices™, you agree to be bound by this Agreement.

2. ELIGIBILITY AND APPLICATION #

2.1 To become a Contributor, you must:

• Be at least 18 years of age (or have parental consent if 13-17)

• Have a valid Utsav Voices™ account in good standing

• Agree to these terms and the Terms of Service

2.2 We reserve the right to accept or reject any Contributor application or submission at our sole discretion.

3. CONTENT OWNERSHIP AND RIGHTS #

3.1 You Retain Full Ownership: You own the rights to the content you create and post on Utsav Voices™. This Agreement does not transfer ownership of any intellectual property rights from you to us .

3.2 Moral Rights: You retain all moral rights in your content, including the right to be identified as the author. We will make reasonable efforts to provide attribution in connection with any use of your content.

4. License Grant TO UTSAV VOICES™ #

4.1 License for Publication: By submitting, posting, or displaying content on the Platform, you grant MyMahotsav a nonexclusive, royalty-free, worldwide, fully paid, and sublicensable license to:

• Host, store, and display your content on the Platform

• Reproduce, modify, adapt, and format your content for technical compatibility with the Platform

• Publish, distribute, and publicly perform your content

• Create derivative works solely for the purpose of promoting the Platform (e.g., excerpts, previews, compilations)

• Use your name, username, and likeness in connection with your content

4.2 Permitted Modifications: This license allows us to make technical modifications necessary for display, such as:

• Reformatting text for different devices

• Creating thumbnails and preview images

• Displaying snippets in feeds and recommendations

4.3 No Right to Sell: This license does NOT grant us the right to sell your content to third parties or license it for independent commercial use without your explicit permission .

4.4 Duration: This license continues for as long as your content is published on the Platform. If you delete your content, the license terminates, though we may retain backup copies as described in Section 8.

5. REPRESENTATIONS AND WARRANTIES #

5.1 By submitting Content, you represent and warrant that :

• You own the content or have all necessary rights, licenses, and permissions to publish it

• The content does not infringe any third-party intellectual property rights

• The content does not violate any applicable laws or regulations

• The content is accurate and not misleading to the best of your knowledge

• The content does not contain defamatory, harassing, or obscene material

• If the content includes images of identifiable individuals, you have obtained necessary model releases

• If the content includes third-party material, you have complied with all applicable license terms

5.2 Third-Party Content: If you include third-party content (e.g., quotations, images), you represent that your use is either:

• Licensed by the rights holder, or

• Permitted as fair use/fair dealing under applicable law

5.3 Indemnification: You agree to indemnify MyMahotsav for any claims arising from breach of these warranties.

6. PUBLICATION AND EDITORIAL CONTROL #

6.1 No Pre-Screening: While we do not pre-screen all content, we have the right to refuse or remove any content for any reason .

6.2 Moderator Review: All submissions undergo review for compliance with our Content Guidelines. This review is not a guarantee of accuracy or quality.

6.3 Editorial Suggestions: We may, at our discretion, provide editorial suggestions. You are not obligated to accept them, but failure to address policy violations may result in rejection.

6.4 No Payment for Publication: Unless otherwise agreed in writing, publication on Utsav Voices™ does not entitle you to any monetary compensation. (Future monetization programs, if introduced, will be governed by separate terms.)

7. POST-PUBLICATION RULES #

7.1 No Editing After Publication: To maintain content integrity and a clear audit trail, articles cannot be edited after publication. This is a fundamental aspect of the Platform’s design .

7.2 Author-Initiated Deletion: You may delete your published articles at any time through your dashboard. Upon deletion:

• The article will be removed from public view within a reasonable timeframe

• A copy may be retained in administrative backups for internal review purposes

• Deleted articles may be permanently unrecoverable

7.3 Platform-Initiated Removal: We reserve the right to remove any content at any time for violation of these Terms or for any other reason .

8. DATA RETENTION AND BACKUPS #

8.1 Backup Copies: We maintain regular backups of the Platform. If you delete your content or account:

• It will be removed from public view as quickly as possible

• Backup copies may remain on our servers for up to 30 days

• After 30 days, backups will be cycled and content permanently unrecoverable

9. ATTRIBUTION AND CREDIT #

9.1 Author Attribution: All published articles will display your name or username as the author, along with a link to your author profile (if you have one).

9.2 Social Media Links: Your author profile may include links to your social media accounts, at your discretion.

9.3 Guest Posts: If you are writing as a guest for a publication, attribution may include the publication’s name in addition to your byline.

10. FUTURE MONETIZATION #

10.1 Potential Monetization: We may introduce monetization features in the future, such as:

• Premium/member-only articles

• Revenue sharing based on engagement

• Tipping or patronage features

10.2 Separate Terms: Any monetization program will be governed by separate terms, which will be provided before participation.

10.3 No Vested Rights: This Agreement does not grant you any right to participate in future monetization programs.

11. TERMINATION #

11.1 By You: You may terminate your Contributor status by deleting your account or ceasing to submit content.

11.2 By Us: We may terminate your Contributor status at any time for violation of these Terms, including:

• Submission of prohibited content

• Copyright infringement

• Harassment of other users

• Breach of representations and warranties

11.3 Effect of Termination: Upon termination, your published articles may be removed at our discretion.

12. NO EMPLOYMENT OR AGENCY #

12.1 Independent Contractor: You are an independent contractor, not an employee, partner, or agent of MyMahotsav. Nothing in this Agreement creates an employment, partnership, or joint venture relationship.

12.2 No Benefits: You are not entitled to any employee benefits, insurance, or workers’ compensation through MyMahotsav.

Part C: Jurisdiction-Specific Addendums #

India Addendum #

Copyright Act, 1957: Moral rights under Section 57 are fully preserved. You retain the right to claim authorship and restrain distortion of your work.

UK/EU Addendum #

Moral Rights: Under the Copyright, Designs and Patents Act 1988, you retain the right to be identified as the author and to object to derogatory treatment of your work.
