Utsav Voices™ is a platform for thoughtful, long-form writing about culture, faith, traditions, and ideas. Whether you’re here to read or to write, we’re glad you’re part of our community.

The Simple Truth #

• You Own Your Words: When you write for Utsav Voices™, you keep full ownership of your work. We just need a license to publish it .

• We’re the Hosts, Not the Authors: The views expressed in articles belong to the authors, not to MyMahotsav. We provide the space, not the opinions.

• Respect Matters: This is a platform for thoughtful discourse. Harassment, hate speech, and misinformation have no place here.

• Once Published, Locked In: To maintain integrity and a clear audit trail, articles cannot be edited after publication (though authors can delete them entirely) .

• We Don’t Sell Your Data: Your personal information is never sold to third parties .

Part B: Legal Terms and Conditions #

1. INTRODUCTION AND ACCEPTANCE #

1.1 These Utsav Voices™ Terms of Service (“Terms”) govern your access to and use of the Utsav Voices™ platform, including all websites, mobile applications, and services offered thereunder (collectively, the “Platform”).

1.2 By accessing or using the Platform, including registering for an account, submitting content, or merely viewing articles, you agree to be bound by these Terms and all policies incorporated herein .

1.3 If you do not agree to these Terms, you must immediately cease using the Platform.

2. DEFINITIONS #

3. ELIGIBILITY AND ACCOUNT REGISTRATION #

3.1 Age Requirement: You must be at least 13 years old to use the Platform. If you are under 18, you represent that you have obtained parental or guardian consent to use the Platform .

3.2 Registration: To submit Content, you must register for an account using accurate, current, and complete information. You agree to update your information as necessary to maintain its accuracy.

3.3 Account Security: You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at support@utsavvoices.com of any unauthorized use .

3.4 One Account Per Person: You may not create multiple accounts or use automated means to create accounts.

3.5 Account Suspension: We reserve the right to suspend or terminate accounts for untrue, inaccurate, or incomplete registration information, or for breach of any term .

4. USER CONDUCT AND RESPONSIBILITIES #

4.1 Your Responsibility: You are solely responsible for Your Content and for your interactions with other users on the Platform. You assume all risks associated with Your Content, including any reliance on its accuracy by others .

4.2 Compliance with Laws: You agree to use the Platform in compliance with all applicable laws and regulations.

4.3 Prohibited Conduct: You agree not to:

• Violate any law, regulation, or third-party rights

• Post, transmit, or share unlawful, defamatory, harassing, obscene, or infringing content

• Impersonate any person or entity

• Harass or stalk any other user

• Use the Platform for unauthorized commercial purposes

• Attempt to gain unauthorized access to the Platform or its systems

• Introduce viruses, malware, or other harmful code

• Interfere with the proper functioning of the Platform

4.4 Content Accuracy: You represent that Your Content is accurate and not misleading to the best of your knowledge.

5. RIGHTS AND OWNERSHIP #

5.1 Your Ownership: You retain all rights to any content you submit, post, or display on or through the Platform. We don’t claim ownership over any of it .

5.2 License to Us: By submitting, posting, or displaying content on or through the Platform, you grant MyMahotsav a nonexclusive, royalty-free, worldwide, fully paid, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and display your content in all media formats and distribution methods now known or later developed on the Platform .

5.3 Why This License is Necessary: This license allows us to:

• Host and display your content on our Platform

• Format your content for different devices (mobile, web)

• Distribute your content across various Platform surfaces

• Create thumbnails, previews, and excerpts with attribution

• Promote your content to readers

5.4 No Sale of Your Content: We will never sell your content to third parties without your explicit permission .

5.5 Platform Content: The look and feel of the Platform, including its HTML/CSS, JavaScript, logos, and visual design elements, are the exclusive property of MyMahotsav Futuretech Ltd and may not be duplicated, copied, or reused without express written permission .

6. SUBMISSION AND PUBLICATION PROCESS #

6.1 Submission: Contributors may submit Articles through the designated front-end submission form. Submissions must include all required information, including title, content, excerpt, categories, and feature image.

6.2 Moderation Review: All submissions undergo a cursory review by Moderators to assess appropriateness and compliance with these Terms. This review is not a guarantee of accuracy or quality .

6.3 Approval or Rejection: We reserve the right, in our sole discretion, to approve or reject any submission for any reason, including but not limited to:

• Violation of these Terms

• Prohibited content (hate speech, profanity, explicit material)

• Spam or low-quality content

• Duplicate submissions

6.4 Publication: Upon approval, the Article will be published on the Platform and categorized appropriately. Contributors will be notified of publication.

7. POST-PUBLICATION RULES #

7.1 No Editing After Publication: To maintain content integrity and a clear audit trail, Articles cannot be edited after publication . This prevents:

• Authors changing narratives after reader engagement

• Disputes about what was originally published

• Manipulation of content that has been cited or referenced

7.2 Author-Initiated Deletion: Contributors may delete their published Articles at any time through their dashboard. Upon deletion:

• The Article will be removed from public view

• A copy will be retained in the administrative backend for internal review purposes

• Deleted Articles may be permanently unrecoverable

7.3 Platform-Initiated Removal: We reserve the right to remove any Content at any time for violation of these Terms, legal requirements, or any other reason .

8. THIRD-PARTY CONTENT AND LINKS #

8.1 Third-Party Content: The Platform may contain links to third-party websites or content. We do not control, endorse, or make any representations regarding third-party content .

8.2 External Links Disclaimer: You access third-party content at your own risk. We are not responsible for any damages or losses arising from your access to or use of third-party content.

9. INTELLECTUAL PROPERTY RIGHTS OF OTHERS #

9.1 Respecting Rights: You may not post content that infringes the intellectual property rights of others. This includes:

• Copyrighted text used without permission

• Images used without license

• Trademark violations

9.2 Repeat Infringer Policy: We will terminate, in appropriate circumstances, the accounts of users who are repeat infringers of intellectual property rights .

10. DISCLAIMER OF WARRANTIES #

10.1 AS IS: THE PLATFORM AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED .

10.2 Specific Disclaimers: TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:

• Implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement

• Warranties that the Platform will be uninterrupted, error-free, secure, or virus-free

• Warranties regarding the accuracy, reliability, or completeness of any Content

• Warranties regarding the views or opinions expressed by Contributors

10.3 No Endorsement: We do not endorse, support, or guarantee the truthfulness, accuracy, or reliability of any Content posted by Contributors.

11. LIMITATION OF LIABILITY #

11.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MYMAHOTSAV, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages

• Any loss of profits, revenue, data, or goodwill

• Any damages arising from use of or reliance on any Content

• Any claims based on user conduct or Content

11.2 Cap on Liability: IN ANY EVENT, OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF:

• The amount paid by you (if any) in the twelve (12) months preceding the claim, or

• £100 (or equivalent in local currency)

11.3 User Actions: You acknowledge that your access and use are at your own risk and discretion.

12. Indemnification #

12.1 You agree to indemnify, defend, and hold harmless MyMahotsav Futuretech Ltd, its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

• Your Content

• Your use of the Platform

• Your violation of these Terms

• Your violation of any third-party rights

13. TERMINATION #

13.1 By You: You may delete your account at any time through your dashboard or by contacting support@utsavvoices.com.

13.2 By Us: We may suspend or terminate your account at any time, with or without notice, for violation of these Terms or for any other reason .

13.3 Effect of Termination: Upon termination, your Content may be removed from the Platform. We may retain backup copies for up to 14-30 days as part of our regular backup procedures .

14. DISPUTE RESOLUTION AND GOVERNING LAW #

14.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of laws principles.

14.2 Informal Resolution: Before filing any claim, you agree to attempt to resolve the dispute informally by contacting us at legal@utsavvoices.com. We will attempt to resolve the dispute within 30 days .

14.3 Arbitration: If the dispute is not resolved informally, it shall be resolved exclusively by binding arbitration in accordance with the rules of the London Court of International Arbitration (LCIA). The arbitration shall take place in London, United Kingdom, and shall be conducted in English.

14.4 Class Action Waiver: YOU AND MYMAHOTSAV AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING .

14.5 Jurisdiction for India: For disputes arising from Users in India, the courts in Gurugram, Haryana shall have exclusive jurisdiction.

15. MODIFICATION OF TERMS #

15.1 We may modify these Terms at any time. If changes are material, we will notify you by email or through a notice on the Platform. Your continued use after changes constitutes acceptance

Part C: Jurisdiction-Specific Addendums #

India Addendum #

IT Act, 2000: Utsav Voices™ is an intermediary under Section 2(w) and complies with due diligence requirements under the IT Rules, 2021.

Grievance Officer: Complaints will be acknowledged within 24 hours and resolved within 15 days as required by law.

UK/EU Addendum #

GDPR: For EU/UK residents, personal data is processed in accordance with GDPR. You have rights to access, rectification, and erasure.

US Addendum #

Section 230: Utsav Voices™ is a provider of interactive computer services and shall not be treated as the publisher or speaker of any information provided by another information content provider.
