Building Trust Through Community Support #
UTSAV DAAN™ invented the Support Group model to make crowdfunding more trustworthy. Instead of one person running a Campaign, a group of verified individuals stands behind it.
How It Works #

What is a Support Group? A team of 2-10 verified individuals who collectively vouch for, support, and help manage a Campaign.

Why have one? Campaigns with Support Groups earn a “Community Verified” badge—donors trust them more.

What do Support Group members do? They verify their identity, confirm the cause is genuine, help with updates, and share responsibility.
-
Is it legally binding? Yes. Support Group members agree to joint responsibility for Campaign representations.

Can anyone join? Support Group members must pass KYC and be approved by the Fundraiser and Platform.
PART B: LEGAL TERMS AND CONDITIONS #
1. DEFINITIONS #

| Community Verified Badge | A visual indicator on Campaign pages denoting enhanced verification through Support Group |
| Collective Responsibility | Joint and several liability for representations made in Campaign materials |
2. SUPPORT GROUP FORMATION #
2.1 Eligibility #
Support Group Members must:

Be at least 18 years of age

Complete KYC verification (identity + address)

Have no prior fraud/ban history on Platform

Not be a politically exposed person (without enhanced due diligence)

Not have conflicting interests (competing campaigns, etc.)

3. ROLES AND RESPONSIBILITIES #
3.1 Collective Responsibilities #
All Support Group Members jointly and severally:

Ensure accurate representations: Review Campaign content for accuracy

Monitor Campaign progress: Stay informed on donations and engagement
-
Respond to donor queries: Address questions in timely manner
-
Provide updates: Contribute to post-Campaign reporting
-
Manage funds responsibly: Oversee utilization consistent with disclosures

Flag concerns: Immediately report any irregularities
3.2 Lead Organizer Specific Responsibilities #
In addition to collective responsibilities, Lead Organizer:

Has final decision authority (subject to group consultation)

Controls bank account for disbursement (unless otherwise agreed)

Primary point of contact for Platform

Responsible for tax compliance

Leads dispute resolution
3.3 Co-Organizer Specific Responsibilities #
Co-Organizers may, depending on permissions granted:

Participate in disbursement decisions
3.4 Support Group Member (Basic) Responsibilities #
Basic members (non-Co-Organizers):

4. LEGAL LIABILITY AND Indemnification #
4.1 Joint and Several Liability #
4.1.1 Support Group Members agree to joint and several liability for:

All representations made in Campaign materials

Fulfillment of promises to Contributors
-
Proper use of funds as disclosed
-
Compliance with applicable laws
-
Any damages arising from Campaign misconduct
4.1.2 “Joint and several” means each Support Group Member can be held responsible for the full amount of any liability, not just their proportional share.
4.2 Indemnification of Platform #
Support Group Members jointly and severally agree to indemnify and hold harmless UTSAV DAAN™, MyMahotsav Futuretech Ltd, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

Breach of this Agreement

Misuse of funds

Violation of applicable laws

Claims by third parties (including Contributors)
4.3 Limitation of Platform Liability #
UTSAV DAAN™ provides the Platform but does not assume liability for:

Campaign outcomes

Fundraiser conduct

Beneficiary performance

Donor satisfaction
Support Group acknowledges that UTSAV DAAN™ is an intermediary, not a guarantor.
4.4 Liability Allocation Among Support Group #
4.4.1 Support Group Members may agree among themselves on internal liability allocation, but such agreements:

Must be in writing

Do not affect joint and several liability to third parties

Are enforceable only between Members
4.4.2 Recommended internal allocation:

Lead Organizer: 50% of liability

Co-Organizers: Remaining 50% equally or as agreed

Basic Members: Lower share reflecting limited role

9. ACKNOWLEDGMENT AND ACCEPTANCE #

PART C: JURISDICTION-SPECIFIC ADDENDUMS #
INDIA ADDENDUM #
Indian Contract Act, 1872: Joint and several liability enforceable under Section 43.
Partnership Concerns: Support Group does not constitute partnership under Indian Partnership Act, 1932, as no profit-sharing.
Tax Implications: Members not liable for tax on funds (funds belong to Beneficiary).
UK ADDENDUM #
Unfair Contract Terms Act 1977: Liability provisions subject to reasonableness test.
Consumer Protection: Members acting in course of business may have additional obligations.
US ADDENDUM #
Joint and Several Liability: Enforceable but varies by state; some states have modified comparative fault.
Charitable Immunity: Some states provide limited immunity for good faith volunteers of charitable organizations.
