Your Rights and Responsibilities When Buying Tickets #
When you purchase tickets through Utsav Pass™, you’re entering into two relationships: one with the Event Organizer (for the event itself) and one with Utsav Pass™ (for the ticketing service).
What You Need to Know #

You’re buying from the Organizer: Your ticket contract is with the event organizer, not Utsav Pass™.

Read the event details carefully: Check dates, times, venue, age restrictions, and cancellation policy before buying.

Tickets are generally non-refundable: Unless the organizer’s policy says otherwise or the event is cancelled .

Your ticket is valuable: Don’t share your barcode—it’s like cash.

Behave at events: Organizers can remove you for bad behavior, and you won’t get a refund.

We protect your data: Your personal information is handled according to our Privacy Policy.
PART B: LEGAL TERMS AND CONDITIONS #
1. CONTRACT FORMATION #
1.1 When you purchase a ticket through Utsav Pass™, you enter into two separate agreements:

(a) An agreement with the Event Organizer for the right to attend the event, governed by the Organizer’s terms and cancellation policy .

(b) An agreement with Utsav Pass™ for the use of the platform to facilitate the transaction.
1.2 By completing a purchase, you acknowledge that:

You have read and understood these Terms
-
You have reviewed the event details and Organizer’s cancellation policy
-
You are at least 18 years of age (or have parental consent)
-
You have the legal capacity to enter into this agreement
1.3 A binding contract between you and the Organizer is formed when:

Your payment is successfully processed; AND
-
You receive confirmation from Utsav Pass™ (email or platform notification)
2. TICKET PURCHASE #
2.1 Ticket Types and Pricing #
2.1.1 Events may offer multiple ticket types with different:

Pricing (early bird, regular, VIP)
-
Access privileges (general admission, reserved seating, backstage)
-
Inclusions (meals, merchandise, parking)
-
Age restrictions
2.1.2 All prices are displayed in the currency specified on the event page. Total price includes:

Ticket face value
-
Applicable taxes (GST/VAT)
-
Utsav Pass™ service fees
-
Payment processing fees (where not included)
2.2 Seating and Admission #
2.2.1 For events with assigned seating:

Seats are allocated based on your selection at purchase
-
Utsav Pass™ and Organizer are not responsible for sight lines obstructed by venue structure or other attendees
-
Seat numbers are final unless the Organizer reasonably needs to relocate you (e.g., for safety, production requirements)
2.2.2 For general admission events:

Admission is on a first-come, first-served basis
-
Arriving early does not guarantee preferred position
-
Venue capacity limits apply
2.3 Delivery of Tickets #
2.3.1 Tickets are delivered electronically:

To the email address provided at purchase

Via SMS to the mobile number provided (where available)

Through your Utsav Pass™ account
2.3.2 You are responsible for:

Providing accurate contact information
-
Ensuring you can receive emails/SMS (check spam folders)

Keeping your tickets secure

Presenting valid tickets for entry (printed or digital)
2.3.3 Utsav Pass™ is not responsible for:

Non-delivery due to incorrect contact information
-
Tickets lost, stolen, or damaged after delivery
-
Duplicate tickets generated by you sharing your barcode
3. PRICING AND PAYMENT #
3.1 Total Price Display #
3.1.1 Before completing your purchase, you will see:

Ticket price breakdown

All fees and taxes
-
Total amount to be charged
3.1.2 No additional charges will be added after confirmation.
3.2 Payment Methods #
Accepted payment methods vary by event and jurisdiction and may include:

Credit/debit cards (Visa, Mastercard, Amex)

UPI (India)
-
Net banking
-
Digital wallets
-
Bank transfers (for select events)
3.3 Payment Processing #
3.3.1 Your payment is processed by Utsav Pass™’s third-party payment partners.
3.3.2 Your card/bank statement will show a charge from “Utsav Pass™” or an identifiable variation.
3.3.3 If your payment fails, your ticket order will be cancelled. You must complete a new purchase.
4. CANCELLATIONS, REFUNDS, AND CHANGES #
4.1 General Rule: Tickets Are Non-Refundable #
4.1.1 Unless otherwise stated in the Organizer’s cancellation policy or required by applicable law, all ticket sales are final and non-refundable .
4.1.2 This includes situations where you:

Change your mind
-
Cannot attend due to personal circumstances
-
Miss the event due to travel delays
-
Are denied entry for violating event rules
4.2 Event Cancellation by Organizer #
4.2.1 If the Organizer cancels an event entirely (not due to Force Majeure), you are entitled to a refund of the face value of the ticket.
4.2.2 Utsav Pass™ service fees may or may not be refundable depending on:

The Organizer’s policy

Payment processor capabilities
-
Platform’s discretion
4.2.3 Refund process:

Organizer initiates refund instruction to Utsav Pass™
-
Utsav Pass™ processes refunds within 14 calendar days
-
Refund credited to original payment method
-
Processing times vary by bank (3-10 business days)
4.3 Event Postponement or Rescheduling #
4.3.1 If an event is postponed to a new date:

Your ticket typically remains valid for the new date
-
You may have the right to a refund within a specified period (usually 14 days of postponement announcement)
-
Check the Organizer’s communication for specific options
4.3.2 If you cannot attend the rescheduled date and the Organizer offers refunds, Utsav Pass™ will process per Organizer’s instructions.
4.4 Material Change to Event #
4.4.1 If the Organizer makes a material change to the event (e.g., changes headliner, significantly alters format), you may be entitled to a refund .
4.4.2 “Material change” does not include:

Changes to supporting acts

Minor schedule adjustments
-
Venue changes within the same locality
-
Start time changes of less than 2 hours
4.5 Force Majeure Cancellation #
4.5.1 If an event is cancelled due to Force Majeure (circumstances beyond the Organizer’s control):

Refunds are at the Organizer’s discretion
-
Neither Organizer nor Utsav Pass™ is liable for additional damages
4.5.2 Force Majeure includes: natural disasters, war, terrorism, government orders, pandemics, epidemics, and other unforeseeable circumstances .
5. TICKET TRANSFERS AND RESALE #
5.1 Ticket Transfers #
5.1.1 Some events allow ticket transfers to another person. Check the event page for transfer availability.
5.1.2 Transfer process:

Log in to your Utsav Pass™ account
-
Select the order and choose “Transfer”
-
Enter recipient’s name and email
-
Recipient receives transfer invitation
-
Transfer completes when recipient accepts
5.1.3 Once transferred:
-
Original ticket becomes invalid
-
New ticket issued to recipient
-
You cannot revoke transfer after acceptance
5.2 Ticket Resale #
5.2.1 Utsav Pass™ may offer official resale for select events.
5.2.2 Unauthorized resale:

Reselling tickets through unauthorized channels is prohibited
-
Tickets sold through unauthorized channels may be cancelled without refund
-
Speculative selling (selling tickets you don’t yet possess) is prohibited
5.2.3 Scalping prevention: Utsav Pass™ reserves the right to limit purchases to reasonable quantities and to cancel orders that appear to be for commercial resale.
6. EVENT ADMISSION AND CONDUCT #
6.1 Entry Requirements #
6.1.1 To gain entry, you must:

Present a valid ticket (digital or printed)

Comply with any age restrictions
-
Consent to security searches (where applicable)

Follow venue and event rules
6.1.2 Organizers and venues reserve the right to:

Refuse admission
-
Require removal of any attendee
-
Cancel tickets without refund for policy violations
6.2 Age Restrictions #
6.2.1 Events may have age restrictions (e.g., 18+, all ages with guardian). Check event page before purchasing.
6.2.2 If you purchase tickets for an age-restricted event and are denied entry due to age, no refund will be issued.
6.2.3 For events with minors, Organizers may require parental/guardian supervision.
6.3 Code of Conduct #
6.3.1 Attendees must:

Respect other attendees, performers, and staff

Follow venue rules and instructions
-
Not engage in harassment, violence, or disruptive behavior

Not bring prohibited items (weapons, illegal substances, etc.)
6.3.2 Violation may result in:

Ejection from event without refund

Ban from future events

Legal action
7. INTELLECTUAL PROPERTY #
7.1 By attending an event, you acknowledge that:

Performances, presentations, and materials are protected by copyright

Unauthorized recording (audio/video) may be prohibited

Professional photography may require separate permission
7.2 Organizers may record events. Your attendance constitutes consent to be filmed/photographed for promotional purposes, unless you opt out where possible .
8. LIMITATION OF LIABILITY #
8.1 TO THE FULLEST EXTENT PERMITTED BY LAW, ORGANIZERS AND Utsav Pass™ SHALL NOT BE LIABLE FOR:

Any indirect, incidental, or consequential damages

Any injuries, losses, or damages occurring at events
-
Any claims arising from Force Majeure
-
Any loss or theft of personal property
8.2 ORGANIZERS’ TOTAL LIABILITY SHALL NOT EXCEED THE PRICE OF THE TICKET.
8.3 Utsav Pass™’S TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID TO Utsav Pass™ FOR THE TRANSACTION.
9. YOUR DATA #
9.1 Your personal information is processed according to our Privacy Policy.
9.2 By purchasing tickets, you consent to:

Utsav Pass™ sharing necessary information with the Organizer (name, email, ticket type)

Organizer contacting you about event updates
-
Utsav Pass™ using your data for platform operations
9.3 Organizers are independent data controllers. Please review their privacy policies for information on their data practices.
PART C: JURISDICTION-SPECIFIC ADDENDUMS #
INDIA ADDENDUM #
Consumer Protection Act, 2019: As a consumer, you have rights against Organizers for deficient services. Utsav Pass™ is a marketplace and will facilitate communication but is not directly liable.
Cancellation & Refund: Organizers must honor cancellation policies disclosed at purchase. Under the Consumer Protection (E-Commerce) Rules, 2020, marketplace platforms must provide seller contact information.
UK ADDENDUM #
Consumer Contracts Regulations 2013: The 14-day cooling-off period DOES NOT APPLY to tickets for leisure events with a specific date .
Chargeback Rights: Under Section 75 of the Consumer Credit Act, your credit card issuer may be jointly liable for purchases over £100 if the Organizer breaches contract.
EU ADDENDUM #
Consumer Rights Directive: Right of withdrawal is excluded for leisure event tickets with a specific date .
US ADDENDUM #
State Laws: Refund rights vary by state. Some states require refunds for cancelled events; others do not. Check local consumer protection laws.
