Part A: Plain English Summary #

Welcome to GyanVapy Courses™! #

GyanVapy Courses™ is a marketplace where you can discover and enroll in courses about culture, faith, spirituality, and traditional knowledge. Some courses are created by MyMahotsav, while others are created by independent instructors.

The Simple Truth #

• We Are the Platform, Not the Teacher: GyanVapy Courses™ provides the technology that allows instructors to share their knowledge with you. Unless explicitly stated, we are not the educator—the instructor is.

• Course Quality Varies: We review courses for policy compliance, but we don’t verify every fact or guarantee teaching quality. Read reviews and previews before enrolling.

• Your Contract is With Us (and Sometimes the Instructor): When you enroll, you’re entering into an agreement with GyanVapy Courses™. For marketplace courses, the instructor also grants you a license to access their content.

• Certificates Are Not Degrees: Unless specifically stated, our certificates of completion are not academic credits, accredited qualifications, or professional certifications.

• Refunds Are Available (With Limits): We offer a standard refund window. Details are in our Payments & Refund Policy.

Part B: Legal Terms and Conditions #

1. Introduction and Acceptance #

1.1 These GyanVapy Courses™ Terms of Use (“Course Terms”) govern your access to and use of the GyanVapy Courses™ platform, including browsing, enrolling in courses, and accessing course content.

1.2 By accessing or using GyanVapy Courses™, you agree to be bound by these Course Terms and all other policies incorporated by reference, including:

• Learner Enrollment Terms (Document C2)

• Payments & Refund Policy (Document C3)

• Honor Code & Learner Conduct Policy (Document C4)

• Certificate Issuance Policy (Document C5)

• Privacy Policy (Document C6)

• Accessibility Policy (Document C7)

1.3 If you are enrolling on behalf of an organization (such as for employee training), you represent that you have the authority to bind that organization to these Terms.

2. Platform Role and Relationship with Instructors #

2.1 GyanVapy Courses™ is a Marketplace: Our platform allows independent instructors (“Instructors”) to create and sell courses to learners (“Students”). We also offer original courses created by MyMahotsav (“GyanVapy Originals”).

2.2 Platform, Not Educator: For marketplace courses, GyanVapy Courses™ provides the technology platform, payment processing, and hosting. The Instructor is solely responsible for:

• The accuracy and quality of course content

• Responding to student questions

• Issuing certificates (where applicable)

• Complying with applicable laws regarding their content

2.3 No Partnership: Instructors are independent contractors, not employees, partners, or agents of MyMahotsav. We are not jointly liable for their actions or omissions.

2.4 GyanVapy Originals: For courses labeled as “GyanVapy Original” or “Produced by GyanVapy,” MyMahotsav acts as the content creator and is directly responsible for the course. These courses are subject to the same Terms but with MyMahotsav assuming the role of Instructor.

3. Accounts and Registration #

3.1 Eligibility: You must be at least 13 years old to use GyanVapy Courses™. If you are between 13 and 18, you confirm you have parental permission to do so.

3.2 Account Creation: To enroll in courses, you must create an account. You agree to provide accurate, current, and complete information.

3.3 Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately at support@gyanvapy.com of any unauthorized use.

3.4 One Account Per Person: You may not create multiple accounts to bypass restrictions or refund limits.

4. Course Enrollment and Access #

4.1 Enrollment: When you enroll in a course, you are purchasing a license to access the course content for personal, non-commercial use. This is not a sale of the content itself.

4.2 Access Duration: Unless otherwise specified, you have lifetime access to courses you’ve enrolled in. “Lifetime” means for as long as the course remains available on GyanVapy Courses™. If we must remove a course for legal or policy reasons, access may be terminated, and refunds will be considered on a case-by-case basis.

4.3 Free Courses: Free courses are subject to the same Terms. We may limit access to free courses or remove them at any time.

4.4 No Sharing: Your enrollment is personal to you. You may not share your login credentials, download and redistribute course content, or otherwise make course content available to others.

5. Payments and Refunds #

5.1 Pricing: Course prices are set by Instructors (for marketplace courses) or by GyanVapy (for Original courses). Prices are displayed in the applicable currency and may include taxes.

5.2 Payment: Payment is processed at the time of enrollment through our third-party payment processors. By providing payment information, you authorize us to charge the applicable fees.

5.3 Refunds: Our refund policy is detailed in the separate Payments & Refund Policy (Document C3). In summary, we offer a 30-day money-back guarantee for most paid courses.

5.4 No Refunds for Abuse: Students who abuse the refund policy (e.g., repeatedly enrolling, downloading content, and requesting refunds) may have their refund privileges revoked.

6. Honor Code and Student Conduct #

6.1 Your Promise: By enrolling in a course, you agree to:

• Complete your own work (for courses with assignments)

• Not plagiarize or copy others’ work

• Not share quiz answers or assignment solutions

• Not use the course for any unlawful purpose

6.2 Prohibited Conduct: You may not:

• Harass instructors or other students

• Post inappropriate or offensive content in course discussions

• Use the platform to promote hate speech or discrimination

• Attempt to reverse engineer or hack the platform

6.3 Violations: Violations of the Honor Code may result in:

• Removal of discussion posts

• Loss of access to courses

• Account suspension or termination

• Forfeiture of any certificates earned through violation

7. Intellectual Property Rights #

7.1 Our IP: GyanVapy Courses™, the GyanVapy logo, and all platform software and technology are the property of MyMahotsav Futuretech Ltd.

7.2 Instructor IP: Course content is the property of the Instructor or their licensors. You are granted a limited, non-exclusive, non-transferable license to access and view the content for personal use only.

7.3 Student IP: You retain ownership of any work you submit (assignments, discussion posts). By submitting, you grant GyanVapy and the Instructor a license to use that work for educational and platform improvement purposes.

8. Certificates of Completion #

8.1 Certificate Issuance: Upon successful completion of a course, you may receive a certificate of completion. Issuance criteria are set by the Instructor and detailed in the course description.

8.2 No Accreditation: IMPORTANT: Unless explicitly stated in the course description, GyanVapy Courses™ certificates:

• Are not academic credits

• Are not professional certifications

• Are not government-recognized qualifications

• Do not confer any degree or diploma

8.3 Verification: Certificates may include a verification code that allows third parties to confirm completion. We do not guarantee that any third party will accept or recognize our certificates.

9. Reviews and Ratings #

9.1 Students may leave reviews and ratings for courses they have enrolled in.

9.2 Reviews must be:

• Based on actual experience with the course

• Constructive and respectful

• Free from profanity, harassment, or discrimination

9.3 We reserve the right to remove reviews that violate these standards.

10. Disclaimer of Warranties #

10.1 AS IS: THE PLATFORM AND ALL COURSE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

10.2 No Educational Guarantee: WE DO NOT WARRANT THAT:

• Courses will meet your specific educational or professional goals

• Course content is accurate, complete, or up-to-date

• Instructors are qualified or competent

• Certificates will be accepted by any third party

10.3 Technical Issues: WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability #

11.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYMAHOTSAV FUTURETECH LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF GYANVAPY COURSES™.

11.2 OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:

• The amount you paid for the specific course giving rise to the claim, or

• £100 (or equivalent in local currency)

11.3 THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Termination #

12.1 We may terminate or suspend your account at any time for violations of these Terms, with or without notice.

12.2 Upon termination:

• Your access to courses ceases

• Any certificates already earned remain valid

• No refunds will be issued for terminations due to violations

13. Governing Law and Dispute Resolution #

13.1 These Terms shall be governed by the laws of England and Wales.

13.2 Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration in accordance with the rules of the London Court of International Arbitration (LCIA), with the arbitration taking place in London, United Kingdom.

13.3 YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS-WIDE ARBITRATION.

14. Changes to These Terms #

14.1 We may modify these Terms from time to time. Material changes will be communicated via email or platform notice.

14.2 Your continued use of GyanVapy Courses™ after changes constitutes acceptance of the modified Terms.

Part C: Jurisdiction-Specific Addendums #

India Addendum #

Consumer Protection: Indian students have rights under the Consumer Protection Act, 2019. Nothing in these Terms limits those rights.

IT Rules, 2021: We comply with intermediary guidelines and have appointed a Grievance Officer as required.

UK/EU Addendum #

Consumer Rights: If you are a consumer, you have rights under the Consumer Rights Act 2015 and Consumer Contracts Regulations. The 14-day cooling-off period for distance selling does not apply to digital content once access has begun .

US Addendum #

State Laws: Some states do not allow limitations of liability for certain damages. The limitations in Section 11 apply to the fullest extent permitted by law in your state.
