The Simple Truth #

We’re a Platform, Not an Employer or Agency: Utsav Volunteers™ provides the technology that allows organizations to post opportunities and volunteers to find them. We are not a party to any volunteer arrangement .

No Verification of Listings: Organizations are responsible for the accuracy of their job posts. We don’t verify the truth of any Listing, the legitimacy of any organization, or the suitability of any volunteer .

Your Interactions Are Your Responsibility: When you apply for a position or contact an organization, you’re interacting directly with that entity. We’re not involved in your communications or relationship.

No Employment Relationship: Volunteers are not employees of MyMahotsav. There is no payment, benefits, or employment rights arising from platform use .

Be Safe and Smart: Use good judgment when sharing information and engaging with organizations. Report any suspicious activity.
Part B: Legal Terms and Conditions #
1. ACCEPTANCE OF TERMS #
1.1 These Utsav Volunteers™ Platform Terms of Use (“Terms”) govern your access to and use of the Utsav Volunteers™ website, mobile applications, and services (collectively, the “Platform”).
1.2 By accessing or using the Platform, including registering for an account, posting a volunteer opportunity, or applying for a position, you agree to be bound by these Terms and all policies incorporated herein .
1.3 If you are accepting on behalf of an organization, you represent and warrant that you have full legal authority to bind that organization to these Terms .
1.4 If you do not agree to these Terms, you must immediately cease using the Platform.
2. DEFINITIONS #

| Organization | Any entity, temple, NGO, community group, or individual that posts volunteer opportunities through the Platform |
| Volunteer | Any individual who searches for, applies to, or accepts volunteer opportunities through the Platform |
| Job Posting | A Listing advertising a volunteer opportunity, including description, requirements, and application instructions |
| Resume/CV | A professional profile created by a Volunteer, which may include skills, experience, and volunteer history |
| User Content | All text, images, data, information, and materials uploaded to the Platform by users |
3. ELIGIBILITY AND ACCOUNT REGISTRATION #
3.1 Age Requirement: You must be at least eighteen (18) years of age to use the Platform. If you are under 18, you represent that a parent or legal guardian has reviewed and agrees to these Terms on your behalf .
3.2 Registration: To post opportunities or apply for positions, you must register for an account using accurate, current, and complete information. You agree to update your information as necessary to maintain its accuracy .
3.3 Account Security: You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at support@utsavvolunteers.com of any unauthorized use .
3.4 One Account Per User: You may maintain only one account. Multiple accounts for the same individual or entity may result in termination.
3.5 Verification: We reserve the right to verify any information provided and to refuse service, terminate accounts, or remove content for any reason .
4. PLATFORM ROLE AND DISCLAIMERS #
4.1 MyMahotsav as Intermediary: MyMahotsav Futuretech Ltd is a technology platform provider. We merely make the Platform available to enable Organizations and Volunteers to find and connect with each other .
4.2 Not a Party to Volunteer Relationships: Any volunteer arrangement entered into between an Organization and a Volunteer is directly between those parties. MyMahotsav is not a party to that arrangement and has no involvement in the actual volunteer activities .
4.3 No Control Over Content: We do not have control over the quality, accuracy, completeness, veracity, or legality of any Job Postings, Resumes, or other User Content .
4.4 No Verification of Users: We do not confirm that any user is who they claim to be. We are not responsible for authenticating users, and it is your responsibility to conduct appropriate due diligence before interacting with other users .
4.5 No Endorsement: We do not endorse any Organization, Volunteer, or Job Posting. Any reference to a third party does not constitute our endorsement .
4.6 Disclaimer of Warranties: THE PLATFORM AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT .
5. PROHIBITED CONDUCT #
5.1 By using the Platform, you agree NOT to engage in any of the following prohibited activities :

| Data Harvesting | Collecting personally identifiable information from the Platform without authorization |
| Impersonation | Impersonating another person or misrepresenting your affiliation |
| Commercial Solicitation | Using the Platform for unauthorized commercial purposes |
| Malicious Uploads | Uploading viruses, worms, or other harmful software |
| False Information | Posting inaccurate, incomplete, or false information |
| Objectionable Material | Posting unlawful, defamatory, offensive, discriminatory, threatening, or obscene material |
6. INTELLECTUAL PROPERTY #
6.1 Platform Content: All content, software, databases, graphics, text, designs, and trademarks on the Platform are proprietary to MyMahotsav or its licensors.
6.2 License Grant: By submitting User Content, you grant MyMahotsav a royalty-free, sublicensable, transferable, non-exclusive, worldwide license to use, reproduce, adapt, translate, publicly perform, publicly display, and make derivative works from such content in connection with the Platform .
6.3 Representations and Warranties: You represent and warrant that you are the creator and owner of your User Content, or have the necessary licenses, rights, consents, and permissions to authorize its use .
7. LIMITATION OF LIABILITY #
7.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYMAHOTSAV SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THESE TERMS OR USE OF THE PLATFORM .
7.2 MYMAHOTSAV SHALL HAVE NO LIABILITY FOR YOUR INTERACTIONS WITH OTHER USERS, OR FOR ANY USER’S ACTION OR INACTION .
7.3 MYMAHOTSAV’S TOTAL LIABILITY TO ANY USER SHALL NOT EXCEED THE TOTAL FEES PAID BY THAT USER (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
7.4 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
8. Indemnification #
8.1 You agree to indemnify, defend, and hold harmless MyMahotsav Futuretech Ltd, its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses arising out of or related to :

Your violation of these Terms

Your violation of any applicable law

Your interactions with other users
9. TERMINATION #
9.1 By You: You may terminate your account at any time through your account settings.
9.2 By Us: We may suspend or terminate your account at any time, with or without notice, for violation of these Terms or for any other reason .
9.3 Effect of Termination: Upon termination, your access to the Platform ceases. User Content may be removed, but we may retain backup copies as required by law.
10. GOVERNING LAW AND DISPUTE RESOLUTION #
10.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of laws principles .
10.2 Informal Resolution: Before filing any claim, you agree to attempt to resolve the dispute informally by contacting us at disputes@utsavvolunteers.com.
10.3 Arbitration: Any dispute arising out of or relating to these Terms that cannot be resolved informally shall be resolved exclusively by binding arbitration in accordance with the rules of the London Court of International Arbitration (LCIA). The arbitration shall take place in London, United Kingdom .
10.4 Class Action Waiver: YOU AND MYMAHOTSAV AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING .
10.5 For disputes arising from Users in India, the courts in Gurugram, Haryana shall have exclusive jurisdiction for any matters not subject to arbitration.

India Addendum #
IT Act, 2000: Utsav Volunteers™ is an intermediary under Section 2(w) and complies with due diligence requirements under the IT Rules, 2021.
UK/EU Addendum #
GDPR: For EU/UK residents, personal data is processed in accordance with GDPR. See our Privacy Policy for details .
US Addendum #
Section 230: Utsav Volunteers™ is a provider of interactive computer services and shall not be treated as the publisher or speaker of any information provided by another information content provider .
Responses
