Part B: Indemnification and Waiver #

1. DEFINITIONS #

1.1 “Releasees” includes the Organization, its employees, officers, directors, officials, agents, assigns, and volunteers .

1.2 “Claims” includes all actions, causes of action, suits, debts, dues, accounts, bonds, covenants, contracts, guarantees, claims, and demands whatsoever in law or equity .

1.3 “Volunteer Activities” includes all tasks, duties, and events associated with the volunteer position, whether on Organization premises or elsewhere.

2. RELEASE AND WAIVER #

2.1 Release of Liability: The Volunteer releases the Releasees from any and all claims for personal injury, property damage, or any other loss that may arise from or be in any way connected to participation in Volunteer Activities .

2.2 Waiver of Claims: The Volunteer waives any right to bring any claim or action against the Releasees for any injury or damage arising from Volunteer Activities .

2.3 Binding Effect: This release and waiver applies to both present and future injuries and binds the Volunteer’s heirs, executors, and administrators .

3. ASSUMPTION OF RISK #

3.1 The Volunteer acknowledges that participation in Volunteer Activities involves certain elements of risk, including but not limited to :

  • Physical exertion and associated injuries

  • Use of equipment and tools

  • Interaction with third parties

  • Natural and manmade environmental conditions

  • Actions of other volunteers or staff

3.2 The Volunteer freely accepts and fully assumes all risks, dangers, and hazards resulting from participation .

4. Indemnification #

4.1 The Volunteer agrees to indemnify and hold harmless the Releasees from any and all claims, demands, actions, and costs that might arise out of or in connection with the Volunteer’s participation in Volunteer Activities .

4.2 This Indemnification includes claims arising from the Volunteer’s own negligence or willful misconduct.

5.1 In the event of injury, the Volunteer consents to receiving first aid or medical treatment from the Organization or its representatives .

5.2 The Volunteer waives any claims against the Releasees arising from such medical treatment, except for gross negligence.

6. INSURANCE ACKNOWLEDGMENT #

6.1 The Volunteer acknowledges that they are not covered by any disability, accident, or medical insurance provided by the Releasees .

6.2 The Volunteer is encouraged to maintain their own health, accident, and liability insurance coverage.

7. GENERAL PROVISIONS #

7.1 Severability: If any portion of this Waiver is found invalid, the remainder will continue in full force and effect .

7.2 Governing Law: This Waiver shall be governed by the laws of the jurisdiction where the Volunteer Activities take place.

7.3 Acknowledgment: By signing, the Volunteer acknowledges having read this Waiver, understands its terms, and signs voluntarily
