Part A: Plain English Summary #

Protecting Our Data from Unauthorized Harvesting #

Our directories contain valuable information—temple details, business listings, contact information. This policy explains the rules about automated access, scraping, and copying our data.

The Simple Truth #

  • No scraping allowed: You may not use automated tools (bots, crawlers, scrapers) to extract our data without permission.

  • Our data is our asset: The compilation of listings is protected by copyright and database rights.

  • Fair use is limited: Viewing listings manually is fine. Automated bulk extraction is not.

  • We block scrapers: We use technical measures to detect and block unauthorized automated access.

  • Violators face consequences: Scraping can result in account termination, legal action, and liability for damages.

1. Definitions #

Term Definition
Scraping The automated extraction of data from our websites using software, bots, crawlers, or other automated means
Crawling Systematically browsing our websites to index or extract content
Automated Access Any access to our platforms by non-human means
Rate Limiting Technical measures to restrict the frequency of requests from a single source

2. Prohibited Activities #

2.1 You may NOT:

  • Use any robot, spider, scraper, or other automated means to access our platforms for any purpose without our express written permission

  • Bypass or circumvent our rate limiting, CAPTCHA, or other technical protections

  • Attempt to disguise automated access as human access

  • Republish or redistribute scraped data

  • Use scraped data to create competing directories or products

2.2 Examples of Prohibited Conduct:

Prohibited Activity Description
Bulk downloading of listings Using automated tools to download thousands of listings
Price scraping Automated collection of pricing information from paid Listing tiers
Contact harvesting Extracting phone numbers or emails for spam
Competitor data theft Copying our directory to create a competing service

3. Permitted Uses #

3.1 Manual Access: You may browse our directories manually, as a human user would, for personal, non-commercial use.

3.2 Search Engine Crawling: Authorized search engines (Google, Bing, etc.) may crawl our public pages subject to our robots.txt instructions.

3.3 API Access: If we offer an official API, you may access it subject to separate terms and rate limits.

4.1 Copyright in Compilations: Our directories, as compilations of information, are protected by copyright law. The selection, coordination, and arrangement of listings constitute original authorship.

4.2 Database Rights: In jurisdictions recognizing database rights (such as the EU), our databases are protected against extraction and re-utilization of substantial parts.

4.3 Terms of Service as Contract: Your agreement to these Terms creates a contractual obligation not to scrape or misuse our data. Violation is both a breach of contract and potentially a tort.

5. Technical Protection Measures #

5.1 We employ various technical measures to detect and prevent unauthorized automated access, including:

  • Rate limiting

  • CAPTCHA challenges

  • IP blocking

  • User agent analysis

  • Behavioral pattern detection

5.2 Attempting to circumvent these measures is a violation of these Terms and may violate computer fraud statutes.

6. Consequences of Violation #

6.1 If we detect scraping or unauthorized automated access:

Violation Severity Potential Consequences
First detection Warning + IP blocking
Continued violation Permanent IP ban + account termination
Commercial-scale scraping Legal action for damages + injunctive relief
Circumvention of technical measures Referral for criminal prosecution where applicable

6.2 Account Termination: Users who scrape data may have their accounts immediately terminated without refund.

6.3 Withholding of Funds: For paid listings, any balance may be withheld in serious cases.

7.1 We reserve the right to pursue all available legal remedies, including:

  • Injunctive relief to stop ongoing scraping

  • Damages for breach of contract

  • Damages for copyright infringement

  • Damages under computer fraud statutes

  • Recovery of attorneys’ fees

7.2 Computer Fraud and Abuse Act (CFAA) : Unauthorized access to our computers may violate the CFAA and similar laws in other jurisdictions.

8. Legitimate Research #

8.1 If you wish to use our data for legitimate academic research, you may request permission by contacting research@mymahotsav.com.

8.2 Permission requests must include:

  • Researcher identity and affiliation

  • Research purpose and methodology

  • Data fields requested

  • Commitment to ethical use

  • IRB approval (if applicable)

8.3 Approved research will be subject to a separate data sharing agreement.

9. Reporting Scraping #

9.1 If you suspect your Listing data is being scraped or misused by third parties, please report to:

  • Email: abuse@utsavlistings.com

  • Include details of the suspected scraping and any evidence
