Part A: Plain English Summary #

Adding Your Temple, Business, or Organization to Our Directory #

This document explains the rules for submitting listings to Utsav Mandirs™ and Utsav Listings™. Whether you’re Listing a temple, your business, or an NGO, these terms apply.

The Simple Truth #

• You’re responsible for your Listing: If you submit information, you’re responsible for making sure it’s accurate and legal.

• We can moderate: We review listings and may reject, edit, or remove anything that doesn’t meet our standards.

• You grant us a license: By submitting, you give us permission to display your information (but you still own it).

• Claim your Listing: If someone else listed your temple or business, you can claim ownership.

• Free and paid options: Basic listings may be free; enhanced features may cost money.

• No guarantee of traffic: Being listed doesn’t guarantee customers, devotees, or visibility.

Part B: Legal Terms and Conditions #

1. Definitions #

2. Eligibility to Submit Listings #

2.1 You may submit a Listing only if:

• You are at least 18 years of age

• You have a valid Utsav World™ account

• You have the legal right to provide the information (either as the entity owner or with permission)

2.2 You may NOT submit Listings for:

• Entities you have no connection to (without authorization)

• Illegal businesses or activities

• Entities that promote hatred, discrimination, or violence

• Entities that violate any applicable laws

3. Information Accuracy and Completeness #

3.1 You represent and warrant that all information you submit is:

• True, accurate, and complete to the best of your knowledge

• Not misleading or deceptive

• Current and up-to-date at the time of submission

3.2 You agree to:

• Promptly update your Listing if information changes

• Respond to platform inquiries about your Listing accuracy

• Correct any errors brought to your attention

3.3 Consequences of Inaccurate Information:

• Listings with material inaccuracies may be suspended or removed

• Repeated violations may result in account restrictions

• You may be liable for damages caused by false information

4. Listing Content Requirements #

4.1 All Listings must comply with our Prohibited Content & Listing Guidelines (Document 4).

4.2 By way of example, Listings may NOT contain :

• Offensive, discriminatory, or harassing language

• False or defamatory statements about others

• Copyrighted materials you don’t own

• Sexually explicit content

• Promotions of illegal activities

• Misleading claims about credentials or qualifications

5. License Grant for Listing Content #

5.1 By submitting a Listing, you grant MyMahotsav Futuretech Ltd a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to :

• Host, store, and display the Listing on our platforms

• Reproduce, adapt, and format the Listing for technical compatibility

• Translate the Listing (where applicable)

• Use the Listing for promotional purposes (with attribution)

• Sublicense these rights to service providers and affiliates

5.2 Exclusive License Option:

If you submit a Listing through a channel that explicitly states “By submitting, you grant MyMahotsav exclusive rights to this content,” you grant an exclusive license for the duration your Listing appears on our platform .

5.3 You retain ownership of your content. This license is solely to enable us to operate the directory service.

6. Listing Verification and Claims #

6.1 Unverified Listings:

• May be submitted by any user

• Subject to moderation review

• Displayed with “Unverified” badge or notation

• May have limited features

6.2 Claiming a Listing:

• Entity owners may claim Listings through the Claim process

• Claim requires verification of ownership (documentation may be required)

• Approved claims transfer management rights to the Claimant

• Previous Submitter is notified of claim

6.3 Disputed Claims:

• If multiple parties claim the same Listing, we may require additional documentation

• We may hold the Listing in unverified status pending resolution

• We do not adjudicate ownership disputes; we may remove the Listing entirely

7. Moderation and Approval #

7.1 All Listings are subject to moderation before publication.

7.2 We reserve the right, in our sole discretion, to :

• Approve or reject any Listing submission

• Edit Listing content for clarity or compliance

• Remove any Listing at any time

• Suspend or terminate Listing privileges

7.3 We are not obligated to provide reasons for rejection or removal, though we typically do so.

8. Premium Features and Payments #

8.1 Some Listing features may require payment (see separate Premium Features & Paid Listing Agreement).

8.2 Free Listings include basic information display.

8.3 Paid features may include:

• Enhanced visibility in search results

• Additional media (photos, videos)

• Priority customer support

• Advanced analytics

• Removal of “Unverified” badge (after verification)

8.4 No Refunds: Fees for premium features are non-refundable except as required by law or specified in the Premium Features Agreement. #

9. Listing Duration and Renewal #

9.1 Listings remain active until:

• Removed by the Listing Owner

• Removed by platform for violations

• The entity ceases to exist or operate

• You request deletion

9.2 We may periodically verify Listing accuracy and contact Owners for confirmation.

9.3 Inactive Listings (no owner login for 2+ years) may be archived or removed.

10. Third-Party Content and Links #

10.1 Listings may include links to external websites or third-party content.

10.2 We are not responsible for:

• The content of external websites

• Any products or services offered through linked sites

• Any transactions you conduct with third parties

10.3 Embedded websites (iFrame feature) are displayed as a convenience. The content is not ours, and we disclaim all liability.

11. Prohibited Commercial Activities #

11.1 You may not use Listings to :

• Engage in deceptive marketing

• Promote pyramid schemes or get-rich-quick schemes

• Sell illegal products or services

• Infringe others’ intellectual property

• Harass or spam users

12. Termination and Suspension #

12.1 We may suspend or terminate Listing access for:

• Violation of these Terms

• Fraudulent or deceptive conduct

• Multiple user complaints

• Illegal activity

• Non-payment of fees

12.2 Upon termination:

• Listing will be removed

• Any fees paid are non-refundable

• You may not re-list without permission

Part C: Jurisdiction-Specific Addendums #

India Addendum #

IT Rules, 2021:

• Listings must not contain information that is “patently false and untrue”

• Grievance Officer must address Listing-related complaints

• First origin information may be required for certain content

UK/EU Addendum #

GDPR: Listing Owners have rights to access, rectification, and erasure of their data.

US Addendum #

Trademark Protection: Listings that misuse trademarks may be subject to removal upon complaint.
