Part A: Plain English Summary #

What We Are and What We Aren’t #

Utsav Mandirs™ and Utsav Listings™ are directories—like a phone book or online business Listing service. We provide a platform where temples, priests, businesses, and NGOs can share information about themselves. But there’s something really important to understand:

WE ARE NOT THE TEMPLE, BUSINESS, OR ORGANIZATION YOU FIND ON OUR PLATFORM.

The Simple Truth #

• We’re a platform, not a provider: Think of us like a bulletin board. People post information, and you can find it. But we didn’t write that information.

• We don’t verify everything: While we try to keep things accurate, we can’t guarantee that every phone number, address, or service description is 100% correct.

• Your relationship is with the listed entity: If you contact a temple through our directory, your relationship is with that temple—not with us.

• We don’t endorse anyone: A Listing on our platform is not a recommendation or endorsement.

• Be smart, be careful: Use the information as a starting point, but do your own research before making important decisions.

Part B: Legal Terms and Conditions #

1. Platform Role and Status #

1.1 Utsav Mandirs™ and Utsav Listings™ are online directory platforms operated by MyMahotsav Futuretech Ltd. We provide technology services that enable users to:

• Search for and discover listed entities (temples, priests, businesses, NGOs)

• View information submitted by or on behalf of those entities

• Contact listed entities through provided channels

• Submit listings for new entities

• Claim ownership of existing listings

1.2 CRITICAL DISCLAIMER – WE ARE NOT A PARTY TO YOUR TRANSACTIONS:

MyMahotsav Futuretech Ltd is NOT:

• The owner, operator, or manager of any temple, business, or organization listed

• A provider of any services offered by listed entities

• An employer, agent, or partner of any listed entity

• A guarantor of any listed entity’s quality, reliability, or legality

• A provider of any professional, religious, or commercial advice

1.3 Intermediary Status:

We are an intermediary under applicable laws , including:

• India: Information Technology Act, 2000, Section 2(w) and Section 79

• EU: E-Commerce Directive / Digital Services Act

• US: Section 230 of the Communications Decency Act

• UK: Online Safety Act (as applicable)

This means we provide the platform but are not responsible for the accuracy or legality of user-submitted content, subject to our moderation obligations.

2. No Endorsement or Warranty #

2.1 A Listing on Utsav Mandirs™ or Utsav Listings™ does NOT constitute:

• An endorsement, recommendation, or approval by MyMahotsav

• A warranty of quality, reliability, or suitability

• Verification of credentials, licenses, or qualifications

• Any representation that the entity is legally compliant

2.2 YOU ACKNOWLEDGE AND AGREE THAT:

• You rely on Listing information entirely at your own risk

• You are responsible for independently verifying any information before acting on it

• MyMahotsav disclaims all liability for decisions you make based on Listing content

3. Information Accuracy Disclaimer #

3.1 Listings are submitted by:

• The entities themselves (after claiming)

• Community members (unverified submissions)

• Third-party sources (where permitted)

3.2 TO THE FULLEST EXTENT PERMITTED BY LAW, MYMAHOTSAV DISCLAIMS ALL WARRANTIES REGARDING Listing ACCURACY, INCLUDING:

• Implied warranties of accuracy, completeness, or reliability

• Warranties that information is current or up-to-date

• Warranties that phone numbers, addresses, or contact details are correct

3.3 Specific Disclaimer for Contact Information:

IF WE MAKE AVAILABLE AN OPTION TO LIST YOUR NAME, ADDRESS, AND/OR TELEPHONE NUMBER IN A DIRECTORY, AND ONE OR MORE OF THE FOLLOWING CONDITIONS OCCURS:

• (1) YOU REQUEST THAT YOUR NAME, ADDRESS AND/OR PHONE NUMBER BE OMITTED FROM A DIRECTORY, BUT THAT INFORMATION IS INCLUDED;

• (2) YOU REQUEST THAT YOUR NAME, ADDRESS AND/OR PHONE NUMBER BE INCLUDED IN A DIRECTORY, BUT THAT INFORMATION IS OMITTED; OR

• (3) THE PUBLISHED OR LISTED INFORMATION FOR YOUR ACCOUNT CONTAINS MATERIAL ERRORS OR OMISSIONS,

THEN THE AGGREGATE LIABILITY OF MYMAHOTSAV AND ITS AFFILIATES, SUPPLIERS OR AGENTS SHALL NOT EXCEED THE MONTHLY CHARGES, IF ANY, WHICH YOU HAVE ACTUALLY PAID TO US TO LIST, PUBLISH, NOT LIST, OR NOT PUBLISH THE INFORMATION FOR THE AFFECTED PERIOD. YOU SHALL HOLD HARMLESS MYMAHOTSAV AND ITS AFFILIATES, SUPPLIERS OR AGENTS AGAINST ANY AND ALL CLAIMS FOR DAMAGES CAUSED OR CLAIMED TO HAVE BEEN CAUSED, DIRECTLY OR INDIRECTLY, BY THE ERRORS AND OMISSIONS REFERENCED ABOVE .

4. Your Relationship with Listed Entities #

4.1 Any interactions, communications, or transactions between you and a listed entity are strictly between you and that entity.

4.2 MyMahotsav is NOT responsible for:

• The quality of services provided by any listed entity

• Any disputes, disagreements, or conflicts between you and a listed entity

• Any damages, losses, or injuries arising from your interaction with listed entities

• Any failure of a listed entity to perform as promised

• Any billing, payment, or refund issues between you and a listed entity

4.3 You agree to pursue any claims directly against the listed entity and not against MyMahotsav.

5. Limitation of Liability #

5.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYMAHOTSAV SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages

• Any loss of profits, revenue, data, or goodwill

• Any damages arising from errors or omissions in listings

• Any claims based on your reliance on Listing information

• Any third-party claims against you

5.2 IN ANY EVENT, MYMAHOTSAV’S TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF:

• The amount you paid us (if any) in the 12 months preceding the claim, or

• ₹1,000 / $10 / £10

6. Indemnification #

6.1 You agree to indemnify, defend, and hold harmless MyMahotsav Futuretech Ltd, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

• Your use of the directory services

• Any information you submit to the platform

• Your interactions with listed entities

• Any violation of these Terms by you

• Any dispute between you and a listed entity

Part C: Jurisdiction-Specific Addendums #

India Addendum #

Information Technology Act, 2000 – Section 79:

• MyMahotsav is an intermediary and shall not be liable for any third-party information, data, or communication link made available on our platform .

• We comply with due diligence requirements under the IT Rules, 2021.

• Grievance Officer contact details are provided separately.

UK/EU Addendum #

Digital Services Act / E-Commerce Directive:

• MyMahotsav qualifies for the “mere conduit” and “hosting” safe harbors where applicable.

• We have no general obligation to monitor user-submitted content.

US Addendum #

Section 230 of the Communications Decency Act:

• MyMahotsav shall not be treated as the publisher or speaker of any information provided by another information content provider.

• Good faith content moderation is protected.
