Part A: Plain English Summary #

What This License Is #

This document spells out exactly what rights you give Utsav World™ when you post content, and what rights you keep.

The Core Deal #

• You grant a license, not an assignment: You’re letting us use your content, not selling it to us.

• We need this to run the platform: Hosting, displaying, sharing, translating, formatting—all the technical stuff required to make Utsav World™ work.

• We can sublicense to service providers: Our cloud hosts, CDN providers, analytics partners—they need limited rights to help us operate.

• We don’t sell your content: This license does not authorize us to sell your photos to stock agencies or license them to third parties for their own commercial use without your separate consent.

• You can delete and revoke: When you delete content, the license ends, subject to backup and archival exceptions.

Part B: Legal Terms and Conditions #

1. License Grant #

1.1 By submitting, posting, or displaying Content on or through the Platform, you grant MyMahotsav Futuretech Ltd a non-exclusive, worldwide, royalty-free, sub-licensable (through multiple tiers), transferable license to use, reproduce, modify, adapt, publish, publicly perform, publicly display, distribute, translate, create derivative works of, and archive such Content in connection with operating and providing the Platform.

1.2 This license is limited to the following purposes:

• (a) Operating, improving, and providing the Platform and its features

• (b) Displaying Content to Users as intended by Platform functionality

• (c) Making technical modifications necessary for cross-device and cross-platform compatibility

• (d) Creating indexing, search, and discovery features

• (e) Analyzing aggregated, anonymized usage patterns

• (f) Promoting the Platform and featured Content with attribution

• (g) Complying with legal obligations and law enforcement requests

1.3 This license does NOT include the right to:

• (a) Sell your Content to third parties for their independent use

• (b) License your Content to stock media agencies

• (c) Use your Content in ways not contemplated by these Terms without your separate consent

2. Duration and Termination #

2.1 The license granted in Section 1 begins when you submit Content and continues until:

• (a) You delete the Content from the Platform; OR

• (b) You close your Account and all associated Content is deleted; OR

• (c) Utsav World™ permanently removes the Content from public display

2.2 Survival: Notwithstanding termination, Utsav World™ may retain:

• (a) Reasonable technical backups for up to 90 days

• (b) Archival copies as specified in the Archival Use Rights Policy

• (c) Records of Content necessary to comply with legal obligations

• (d) Aggregated, anonymized data that no longer identifies you

3. Sublicensing #

3.1 Utsav World™ may sublicense rights under Section 1 to:

• (a) Service providers and contractors who assist in Platform operations (subject to written agreements requiring compliance with these Terms)

• (b) Other Users as necessary to enable Platform functionality (e.g., sharing, embedding, collaboration features)

• (c) Affiliates of MyMahotsav Futuretech Ltd

3.2 Any sublicensee shall be bound by terms no less restrictive than those contained in this License.

4. Reservation of Rights #

4.1 You retain all ownership and intellectual property rights in your Content.

4.2 You may license your Content to others independently, including on a commercial basis, without restriction from Utsav World™.

4.3 Nothing in this License restricts or impairs your Moral Rights.

5. Feedback and Suggestions #

5.1 If you provide Utsav World™ with suggestions, recommendations, or feedback regarding the Platform:

• You grant Utsav World™ a perpetual, irrevocable, royalty-free license to use and incorporate such feedback without compensation or attribution

• This license survives termination of your Account

• You waive any Moral Rights in feedback to the extent permitted by law

6. Non-Exclusivity #

• Post the same Content on other platforms
• License the same Content to other services
• Sell or transfer your Content to third parties
• Remove Content from MyMahotsav while maintaining other distributions

Part C: Jurisdiction-Specific Addendums #

India Addendum #

Copyright Act 1957:

• License does not affect your right to receive royalties for statutory licenses

• Moral Rights under Section 57 are fully preserved

UK/EU Addendum #

Copyright Directive Compliance (Directive 2019/790) :

• Article 17: Utsav World™ makes best efforts to obtain licenses and prevent unauthorized protected content

• Uploaded Content does not affect your statutory exceptions and limitations

• Complaint and redress mechanisms available as required

US Addendum #

DMCA Compliance:

• This License does not waive your right to file DMCA takedown notices for unauthorized use outside this License

• Utsav World™ is a service provider under 17 U.S.C. § 512(c)
