Part A: Plain English Summary #

International Bookings and Legal Framework #

Utsav Venues™ connects hosts and renters around the world. This addendum explains how cross-border bookings work and which country’s laws apply in case of disputes.

The Simple Truth #

• Bookings May Cross Borders: You might book a venue in another country, or host international renters. Different laws may apply.

• Host’s Location Governs Venue: The venue itself is subject to local laws (safety, licensing, etc.). Hosts are responsible for compliance .

• Platform Terms Governed by UK Law: Our Terms of Service are governed by English law, regardless of where you’re located .

• Currency Conversion: Prices may be displayed in multiple currencies; your bank may charge conversion fees.

• Local Laws Always Apply: Nothing in our terms overrides mandatory consumer protection laws in your country.

Part B: Cross-Border Provisions #

1. GOVERNING LAW #

1.1 Platform Terms: These Terms and any dispute arising out of or relating to them shall be governed by the laws of England and Wales, without regard to its conflict of laws principles .

1.2 Venue Rental Contracts: The rental agreement between Host and Renter may be subject to different governing law, depending on the location of the Venue and the parties’ agreement. Hosts should specify governing law in their house rules or rental contract.

1.3 Consumer Protection: Where mandatory consumer protection laws in your country of residence provide greater protections, those laws shall apply to your relationship with the Platform.

2. JURISDICTION AND VENUE #

2.1 Platform Disputes: Any legal action concerning the Platform (as opposed to the Venue rental) shall be brought exclusively in the courts of London, England .

2.2 Venue-Related Disputes: Disputes between Hosts and Renters regarding the Venue itself may be subject to jurisdiction where the Venue is located, where the parties agree, or as determined by applicable law.

3. CURRENCY AND PAYMENTS #

3.1 Displayed Currency: Prices may be displayed in multiple currencies based on your location. The currency displayed is for reference only.

3.2 Transaction Currency: The actual transaction will be processed in the currency specified at checkout.

3.3 Currency Conversion: If your payment method uses a different currency, your bank or card issuer may apply currency conversion fees. These are your responsibility.

4. LOCAL LAW COMPLIANCE #

4.1 Host Responsibility: Hosts are solely responsible for ensuring their Venue complies with all applicable local laws, including :

• Zoning and land use regulations

• Building and fire safety codes

• Alcohol licensing laws

• Noise ordinances

• Accessibility requirements

• Tax obligations

4.2 Renter Responsibility: Renters are responsible for complying with local laws during their event, including laws regarding:

• Alcohol consumption

• Noise restrictions

• Age requirements

• Public gatherings

5. INTERNATIONAL DISPUTE RESOLUTION #

5.1 Cross-Border Disputes: For disputes involving parties in different countries, the following approach applies:

5.2 Hague Convention: For cross-border service of process, the Hague Convention on Service Abroad may apply.

6. DATA TRANSFERS #

6.1 International Data Transfers: Your personal data may be transferred to and processed in countries other than your own. We implement appropriate safeguards for such transfers, including Standard Contractual Clauses where required.

7. LANGUAGE #

7.1 Official Language: These Terms are drafted in English. Any translations are for convenience only. In case of conflict, the English version shall prevail .

Part C: Country-Specific Provisions #

India #

Jurisdiction: For disputes involving Indian users, the courts in Gurugram, Haryana shall have exclusive jurisdiction for Platform-related matters.

Consumer Protection: Indian consumers have rights under the Consumer Protection Act, 2019 that cannot be waived.

United States #

State Variations: Some states have specific venue and jurisdiction requirements. Nothing in these Terms waives your right to bring claims in a court of competent jurisdiction where required by law.

European Union #

Brussels I Regulation: For EU consumers, jurisdiction may be determined by the Brussels I Regulation (recast), allowing you to sue in your home member state.
